Wills in Statesville

A will gives instructions for handling matters covered by the document. It does not automatically control every asset: ownership arrangements and beneficiary designations may direct some assets separately. A useful first step is to compare what your documents say with how each asset is currently titled or designated.

Separate will instructions from other transfers

Start by listing the assets you expect your will to address, then identify any ownership arrangement or beneficiary designation that may govern an asset outside those instructions. The comparison can reveal where your plan relies on different documents or records, rather than on the will alone.

A will and a trust are also distinct planning tools. If you have trust documents, review their terms alongside the will and note which assets are associated with the trust. The appropriate arrangement depends on your circumstances and the documents involved.

Choose who will carry out each role

Consider who you want to handle the responsibilities assigned by your will, and identify an alternate if appropriate. Keep that role separate from a trustee named in a trust and from an agent named in a power of attorney. Those roles arise from different documents and should not be treated as interchangeable.

A power of attorney authorizes someone to act on your behalf while you are living, subject to that document’s scope, duration and limits. It is not a substitute for naming the person who will handle matters under a will. If the people you have selected differ across documents, make a note to ask whether the arrangement is intentional.

      Prepare a document-and-record comparison

Bring a current list of assets and, where available, records showing ownership or beneficiary designations. Set it beside your will and any trust documents. For each item, record what the will says, how the asset is titled, whether a beneficiary is named, and what question remains. This comparison is a practical way to identify possible inconsistencies without assuming that a single record answers every legal question.

For assets connected to land in Wilson County, the county Register of Deeds directory lists a separate land-record contact at P.O. Box 176, Lebanon, TN 37087. The address may be a mailing address, so confirm before visiting. A directory contact or recorded document does not by itself determine ownership, guarantee clear title or establish the appropriate transfer or court procedure.

      • Gather your current will and any amendments, trust documents, and available ownership or beneficiary records.
      • Mark conflicting names, missing information, and assets whose treatment under the will is unclear.
      • Write down questions about who should act, which document governs, and whether a record needs further review.

Discuss the plan and any unresolved records

Dale Law Group, PLLC offers wills, pour-over wills and trust planning, among other estate-planning services. A discussion can focus on whether your will’s instructions align with the ownership and beneficiary information you have gathered, and whether related documents should be considered together.

Statesville is an unincorporated Census-designated place in Wilson County, not a separate functioning municipal government. Dale Law Group’s only office is in Murfreesboro; no Statesville office is represented here. For a question involving county records, confirm current contact details before relying on a directory address or making a visit.

Questions to bring to the discussion

Does a will control every asset I own?

Not necessarily. Ownership arrangements and beneficiary designations may direct some assets separately from will instructions. Compare those records with your will and ask how any inconsistency should be addressed.

Are an executor, trustee and power-of-attorney agent the same role?

No. These roles come from different documents and have different authority. A power of attorney’s scope, duration and limits depend on that document; do not assume it grants every power or replaces a role named in a will or trust.
