Wills and estate planning

Wills Lawyers in Spurgeon TN

A will records your instructions, but it is only one part of the picture. Before drafting or updating one, compare what you want the will to say with how your property is owned and whether any beneficiary designations may direct an asset separately.

What a will does after a death

A will states who should receive property passing through the estate and can nominate the executor who will administer it. It can also record a parent’s preferred guardian for a minor child, subject to the court’s authority. A will operates after death; it does not authorize someone to manage your finances or healthcare while you are alive.

Some property passes through a beneficiary designation, joint ownership or a trust instead of the will. The document therefore needs to fit the ownership and beneficiary records for each asset. A will can be important without controlling every account or avoiding probate.

From planning decisions to a usable document

Will preparation involves choosing beneficiaries and alternates, deciding who should administer the estate, addressing any minor-child concerns and coordinating property that passes outside the will. Review the proposed document and the applicable Tennessee execution requirements before signing; a downloaded form, an unsigned draft and a validly executed will are not equivalent.

Keep the signed original somewhere it can be located after death, and tell the appropriate person how to find it. Revisit the plan after a marriage, divorce, birth, death or significant ownership change. Probate administration is a separate service: the court considers the will and the authority needed to settle the estate.

      Make a property-and-instructions worksheet

A useful first step is a simple worksheet with one row for each significant asset. Record what it is, how it is titled or owned, any beneficiary named in the associated records, and what you want your estate plan to accomplish with it. Add a column for the document or statement that supports each entry and mark missing or uncertain information for follow-up.

Gather the current will and any trust documents, account or policy beneficiary records, deeds or other ownership records, and notes about changes you want to make. Keep copies together, and distinguish confirmed information from assumptions. A land-record contact or recorded document alone does not establish clear title or determine which transfer or court procedure is appropriate.

        Account for Spurgeon’s county geography

If a future estate matter involves a filing, identify the relevant county and confirm current instructions with the appropriate court office rather than relying on the place name alone.

Washington County’s official court information distinguishes Chancery and Probate divisions and identifies the Probate Division for estate-administration and will-probate filings. The counties also have separate Registers of Deeds contacts. Confirm the relevant office and current details before relying on a directory listing.

Questions to bring to a planning conversation

Ask whether your will’s instructions match the ownership and beneficiary records you gathered, what information is still missing, and whether a trust or another estate-planning document should be considered alongside a will. If you are updating an existing plan, identify what changed and which records may need review together.

Dale Law Group, PLLC serves clients across Tennessee from its Murfreesboro office. Planning can address the documents and the practical questions about how they fit together; a document’s effect depends on its terms and the property involved.

Questions to bring to the discussion

Does a will avoid probate or manage my affairs while I am alive?

A will gives directions for the estate after death; it does not itself avoid probate or give someone lifetime financial or healthcare authority. Which assets require estate administration depends on their ownership and transfer arrangements. Powers of attorney and healthcare documents address separate lifetime needs.

Does a will necessarily control every asset?

Not necessarily. Ownership arrangements and beneficiary designations may affect how particular assets pass. Compare those records with your will rather than assuming the will directs every asset.

Which county should I contact about a future probate filing?

Confirm the relevant county, court division, and current instructions for the specific matter; office directories are not a determination of venue or whether a filing is needed.
