Trust Administration in Oak Grove, Washington County

Serving as a trustee involves more than locating a trust document. Before moving money or making a distribution, identify what the trust authorizes, what property it covers, and what records or questions still need attention. Dale Law Group, PLLC offers trust-administration services to clients in Tennessee, including Oak Grove.

Start with authority, not assumptions

A trustee’s role is different from an executor’s role and from an agent acting under a power of attorney. Those roles rely on different sources of authority; one document does not automatically give a person every kind of decision-making power. Identify who is acting, in what capacity, and which document supports that role before taking action.

Read the trust and any amendments together, noting who is serving as trustee, what decisions the terms address, and whether there are instructions about distributions or successor trustees. If documents are incomplete, unclear, or inconsistent, pause proposed actions that depend on the disputed point and get the issue clarified.

Match trust terms to property and accounts

A useful first working document is an asset-and-account reconciliation: list each item that may belong to the trust, how it is titled, the institution or record that can confirm the information, and any open question. Compare that list with the trust’s terms rather than assuming that every asset associated with a person is trust property.

For each account or asset, record whose name appears on the current statement or ownership record, whether the trust is identified, and what supporting document is available. Note missing statements, unclear ownership, and assets that may require separate follow-up. A recorded land document or directory contact alone does not establish ownership or determine the appropriate transfer process.

      Log proposed distributions before acting

Keep a distribution log with the proposed recipient, amount or property, purpose, supporting trust provision, documents reviewed, and the question that must be resolved before proceeding. This creates a practical checkpoint: does the trust address this distribution, is the asset within the trust, and is the person making the decision acting as trustee?

Do not treat a power of attorney as interchangeable with trustee authority. A power of attorney’s scope, duration, and limits matter, and it authorizes an agent to act on someone else’s behalf. If the trustee’s authority or a proposed distribution is uncertain, identify the uncertainty before making the transfer.

Prepare for tax and local process questions

Trust income-tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ. The trust’s name or label alone does not establish its tax result. Gather the trust instrument and amendments, relevant account statements, income and expense records, and prior tax documents for a focused review of reporting questions.

Oak Grove is an unincorporated Census-designated place, not a separate city government. If an issue also involves a decedent’s estate, Washington County’s official information distinguishes Chancery and Probate divisions, and identifies the Probate Division for estate-administration and will-probate filings. Confirm which division and current instructions apply; that information does not itself determine whether a proceeding is needed or the correct process for a trust matter.

Questions to bring to the discussion

What should I bring to a trust-administration discussion?

Bring the trust and amendments, any documents naming or changing trustees, current statements or ownership records for relevant assets, recent income and expense records, and a list of proposed distributions and unresolved questions. Mark missing documents rather than guessing.

Does a trust automatically determine how its income is reported?

No. Tax treatment and reporting depend on the trust, and grantor-trust and separate-entity treatment differ. The trust label by itself does not determine the result; gather the trust documents and relevant financial records for review.
