Guardianship and Conservatorship in Oak Grove, Washington County

When someone needs help with decisions, first clarify who needs support, which decisions are at issue, and what authority already exists. A minor-support question and an adult decision-support question call for different preparation; neither should be treated as interchangeable with a power of attorney or other role.

Start with the person and the decisions involved

For a minor, identify the particular care or decision-making concern and the people currently involved. For an adult, describe the decisions where assistance may be needed and the person’s own preferences, as best they can be understood. These are useful starting points for discussing whether guardianship or conservatorship should be considered; they do not predict what a court will decide.

Separate financial matters from healthcare choices and day-to-day support. A financial power of attorney, healthcare power of attorney, advance healthcare directive, trustee role, and court-appointed guardian or conservator are different roles. The document or appointment controls the authority it grants; do not assume one role covers every decision.

Compare existing authority with a court-appointed role

Gather any powers of attorney, healthcare directives, court orders, and trust documents that may relate to the situation. For each, note who is named, what decisions it addresses, any stated limits or duration, and whether it appears current. A power of attorney authorizes an agent to act on another person’s behalf, but its scope, duration, and limits matter.

Then compare the identified needs with the authority already documented. Consider whether a narrower form of assistance or an existing authorized person may address the specific issue, or whether a court process should be discussed. The right next step depends on the circumstances and applicable law; this comparison is preparation, not a conclusion that a proceeding is required or that a court will grant a request.

      Prepare a decision-and-authority inventory

Before a consultation, make a one-page inventory with three columns: decision or task; document or person currently connected to it; and question or gap to resolve. Add a short note about the person’s preferences and any practical support they want. This helps keep the discussion focused on actual needs rather than labels alone.

Bring copies of relevant documents and a concise list of people involved. Include any existing court papers, powers of attorney, healthcare directives, and trust documents that may bear on the question. For healthcare authority, Tennessee’s advance directive form addresses an agent or alternate and healthcare preferences; keep those instructions distinct from financial authority.

Questions to take to a discussion

Ask: What decisions need support, and which are financial, healthcare-related, or otherwise? What authority do the existing documents actually provide, and what limits or gaps should be clarified? Are there narrower alternatives worth considering before seeking a court appointment? What information about the person’s preferences and current support would help evaluate the options?

For Washington County matters, the county identifies separate Chancery and Probate divisions, and its Probate Division receives estate-administration and will-probate filings. That information does not establish the correct venue or filing for a guardianship or conservatorship question. Confirm the appropriate division and current instructions for the specific matter rather than relying on a general office listing. Dale Law Group, PLLC offers guardianship and conservatorship services in Tennessee; its office is in Murfreesboro, not Oak Grove.

Questions to bring to the discussion

Is a power of attorney the same as a conservatorship?

No. A power of attorney authorizes an agent to act within the document’s scope, duration, and limits. A conservator is a court-appointed role. Review the actual documents and orders rather than assuming the roles are interchangeable.

Does a Washington County court-office listing tell me where to file?

Not by itself. The county lists separate Chancery and Probate divisions, and its Probate Division receives estate-administration and will-probate filings. Confirm which division and current instructions apply to the specific guardianship or conservatorship matter.
