Advance healthcare directives and living wills
Advance Healthcare Directives and Living Wills in Luttrell
An advance directive needs to do more than name someone. It should help that person understand the care you value and give them a clear way to act when you cannot communicate. We help you consider your healthcare preferences, agent designation and how older instructions fit with your current wishes.
Compare the choices you are making
A Tennessee Advance Directive for Health Care addresses both an agent or alternate and healthcare preferences. Those parts answer different questions: whom you want involved in decisions, and what care matters to you. Consider both rather than treating the document as only a choice of representative.
An agent designation is also distinct from a financial power of attorney. A power of attorney authorizes someone to act on your behalf, but its scope, duration and limits matter; it should not be assumed to grant every authority. Healthcare authority, financial authority and access to health information are separate planning questions.
- Who would understand your values and communicate them if you could not speak for yourself?
- What preferences, priorities or concerns would help that person make decisions consistent with your wishes?
- Do existing instructions still reflect what you want, and do they fit with the person you would now name?
Make your wishes understandable
A useful starting point is a short preferences note in your own words. Describe what matters most to you, what concerns you want someone to understand, and what questions you want to discuss with your chosen agent. This note can guide a conversation; it is not a substitute for the directive itself.
The Tennessee form includes an agent or alternate and healthcare preferences, along with instructions about signing the document and sharing copies. Follow the form’s current instructions rather than relying on a remembered signing process. Once you have completed the planning conversation, consider who needs a copy so the document can be found when relevant.
Bring existing documents into the conversation
Gather any prior healthcare directives, healthcare power of attorney documents, HIPAA authorizations and notes expressing care preferences. For each, identify its date, the person named, and the subject it addresses. An information-access authorization is not itself a statement of care preferences, and a financial agent’s role is not automatically the same as a healthcare agent’s.
If you have named different people in different documents, or your wishes have changed, flag that for review. The goal is to understand what each document says and whether the documents work together—not to assume that an older instruction is still the best fit or that one document replaces every other planning need.
Prepare for a focused review
Before a planning discussion, bring your preferences note and a copy of each relevant document you can locate. Mark anything you do not understand, any names or contact details that may be outdated, and any point where your written instructions may not reflect what you would tell your chosen agent today.
Dale Law Group, PLLC offers advance healthcare directive and living-will planning, healthcare powers of attorney and HIPAA authorizations. We can help coordinate these documents with your stated wishes. The firm’s office is in Murfreesboro and serves clients across Tennessee; no Luttrell office is represented here.
- Which document addresses healthcare preferences, which names an agent, and which addresses information access?
- What should your agent understand about your priorities, and what questions do you want to discuss together?
- If you cannot locate an older document or find conflicting instructions, what should be reviewed before you rely on it?
Questions to bring to the discussion
Does naming a healthcare agent describe all of my care preferences?
Not by itself. Tennessee’s advance directive form addresses an agent or alternate as well as healthcare preferences. Consider both who you want involved and what you want that person to understand.
Is a healthcare power of attorney the same as a financial power of attorney?
They concern different planning roles. A power of attorney’s scope, duration and limits matter, so do not assume a financial document gives healthcare authority or that any one document covers every need.
