Trust Administration
Trust Administration in Gilt Edge
When you are named trustee, the first question is not simply what the trust says. You also need to establish that the trust governs the asset in question, identify what authority you hold, and understand what information is still missing before making a distribution. Dale Law Group, PLLC, assists with trust administration in Gilt Edge and throughout Tennessee.
Start with authority and the asset
A trustee’s role comes from the trust and applies to property held in or governed by that trust. It is different from an executor’s role in administering an estate and from an agent’s authority under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not automatically make that person trustee or give authority over trust property.
Before taking action, identify the trust document and any amendments, the person or institution serving as trustee, and the particular asset at issue. Then compare the trust terms with account statements, deeds, or other ownership records. A trust’s name by itself does not establish how an asset is titled or determine the tax treatment.
- What document establishes the current trustee’s role, and are there amendments or related records to locate?
- Does the ownership information for this account or property match the trust arrangement you are reviewing?
Compare the proposed action with the trust terms
For each proposed payment or transfer, record the asset, intended recipient, amount or property involved, reason for the request, relevant trust provision, and any supporting document. Mark unresolved questions instead of treating an informal request or an account label as authorization. This running decision log helps you see which actions appear supported by the documents and which should wait for clarification.
If the trust document is incomplete, conflicting, or difficult to interpret, or if ownership records do not match the expected arrangement, pause the proposed action while you gather the missing information. Do not substitute an executor’s, agent’s, or beneficiary’s understanding for the trustee’s authority.
- Decision log: date; proposed distribution; trust provision to review; ownership evidence; supporting records; unresolved issue; next step.
- Keep copies of relevant trust documents, amendments, current account or property records, and written requests together with the log.
Account for tax and property records
Trust income-tax reporting depends on the trust’s tax treatment. Grantor-trust and separate-entity treatment differ, so the trust label alone does not establish the reporting result. Gather relevant tax records and ask how the trust is treated before assuming which reporting approach applies.
If administration involves Tipton County land records, the Register of Deeds directory lists a separate county contact at P.O. Box 626, Covington, TN 38019. This may be a mailing address, so confirm before visiting. A directory contact or recorded document does not establish ownership, guarantee clear title, or decide which transfer or court procedure is appropriate. A records inquiry is not a substitute for reviewing the trust and property documents.
Prepare for a focused administration discussion
Bring the trust and amendments, documents showing who is serving as trustee, a current list of trust assets, recent account or property ownership records, available tax information, and your distribution log. Note any missing document and who may have it. Dale Law Group, PLLC, offers trust administration services; a discussion can focus on the trustee’s authority, the records that govern each asset, and the questions to resolve before acting.
- Which assets are confirmed as trust property, and what record supports that conclusion?
- What trust provision applies to each proposed distribution?
- What information or document is missing, and should the action wait until it is obtained?
Questions to bring to the discussion
Can an agent under a power of attorney make decisions for a trust?
Not simply because the person is an agent. A power of attorney and a trusteeship are distinct roles, and the power granted by a document has scope and limits. Identify the relevant document and the authority it provides before relying on it for a trust-related decision.
Does a trust’s name determine how its income is reported?
No. Trust income-tax treatment and reporting depend on the trust, and grantor-trust and separate-entity treatment differ. Gather the trust and tax records rather than assuming the result from the trust’s label.
