Trust Administration
Trust Administration in Brighton
A trustee’s authority comes from the trust and the trustee’s role—not from an executor’s appointment or another person’s power of attorney. Before handling accounts or considering distributions, identify the controlling documents, confirm how assets are titled, and keep a clear record of decisions.
Start with authority, not assumptions
Trustee, executor, and agent under a power of attorney are distinct roles. A trustee acts under the trust; an executor’s role relates to estate administration; an agent acts under the scope and limits of a power of attorney. One person may hold more than one role, but that does not make the authority interchangeable.
Gather the complete trust and any amendments, documents identifying the current trustee, and relevant estate or power-of-attorney papers. If a bank or other institution requests proof of authority, compare its request with the documents before responding or taking action.
Compare the trust terms with account ownership
Make an asset-by-asset list showing the account or property, how it is titled, the institution or record source, and the document that appears to connect it to the trust. A trust’s name alone does not establish how an account is owned or how it should be handled.
Flag mismatches, incomplete statements, missing amendments, unclear ownership records, or assets whose connection to the trust is uncertain. Resolve those questions before treating an asset as available for a distribution. For Tipton County land records, the Register of Deeds directory lists a contact address in Covington; confirm current contact and access instructions before relying on it. A directory entry or recorded document does not itself establish ownership or determine the appropriate transfer process.
Log proposed distributions before acting
For each proposed distribution, record the trust provision you believe applies, the person or purpose involved, the amount or property under consideration, the information reviewed, and any unresolved question. Keep supporting statements, receipts, correspondence, and a note of the decision and its reason with the administration records.
Use the log to distinguish a clear instruction from a decision that depends on missing information or interpretation. If the trust language, asset ownership, or trustee authority is uncertain, pause that proposed action while the issue is clarified rather than relying on assumptions about what another role-holder could authorize.
A practical first review
Bring the trust and amendments, trustee-identification documents, current asset and account statements, relevant deeds or ownership records, prior distribution records, and correspondence from financial institutions. Mark what is missing and list questions beside each uncertain asset or proposed payment.
Dale Law Group, PLLC offers trust administration services. The firm’s office is in Murfreesboro and it serves Tennessee; Brighton is in Tipton County. For local contact information, UT CTAS lists a Clerk & Master contact in Covington, but office listings do not establish whether a court proceeding is required, the proper venue, or a filing requirement. Verify current office instructions before relying on a contact listing.
Questions to resolve next
Useful questions include: Which trust version governs? What document establishes the current trustee’s authority? Which assets are actually titled to or otherwise connected with the trust? What trust provision supports each proposed distribution? What information or record is still needed before proceeding?
Trust income-tax reporting depends on the trust’s treatment; grantor-trust and separate-entity treatment differ. The trust label alone does not determine the tax result. Keep tax questions distinct from trustee authority and distribution decisions, and identify them for appropriate review.
Questions to bring to the discussion
Does a power of attorney let an agent administer a trust?
Not automatically. A power of attorney authorizes action on another person’s behalf within its scope, duration, and limits. Trustee authority is a separate role governed by the trust and the documents establishing who is serving as trustee.
Does an asset belong to a trust just because the trust is named in paperwork?
Not necessarily. Compare the trust terms with current account or property ownership records, and resolve inconsistencies before treating an asset as available for administration or distribution.
