Estate Planning and Probate
Estate Planning and Probate in Castalian Springs
Start with the decision you need to make: plan for who can act and receive property in the future, or address responsibilities after someone has died. The right documents and process depend on the assets, existing arrangements and the authority each person needs.
Planning ahead or administering an estate?
Planning is about putting instructions and decision-making authority in place while you can make choices. Administration is about carrying out responsibilities after a death under the applicable will, trust or other arrangements. These are related services, but they are not interchangeable.
For planning, Dale Law Group, PLLC offers wills, trusts, financial powers of attorney and healthcare documents. For administration, services include probate and trust administration. A death does not, by itself, tell you which route applies; the relevant documents and property arrangements need to be considered.
Choose documents by the job they need to do
A will states instructions for property addressed by the will. A pour-over will and a revocable living trust are distinct tools that may be considered together, but a trust does not make a will, beneficiary designation or other arrangement irrelevant. Trusts may also serve different purposes, including special-needs, charitable, pet or asset-protection planning; the label alone does not establish what terms are appropriate.
A financial power of attorney authorizes another person to act on your behalf. Its scope, duration and limits matter, and it should not be treated as authority for every decision. Healthcare authority and preferences belong in healthcare planning documents, such as an advance healthcare directive; HIPAA authorization addresses information access, not the same decision-making role.
Prepare a clear picture before choosing a route
A useful first step is to gather the documents and information that show what exists and who has which role. Bring any current will, trust, powers of attorney, healthcare directive and relevant beneficiary-designation information, along with a general inventory of property and obligations. Note property held individually, jointly or through a trust where you know that information.
For an administration matter, gather the will or trust, information about assets and debts, and any notices or correspondence already received. Identify the people named to act and distinguish an executor or trustee from an agent under a power of attorney. A power of attorney does not make its agent the person responsible for trust or estate administration.
Sumner County records and the practical next step
Castalian Springs is an unincorporated Census-designated place, not a separate city government. For a Sumner County court-office contact, UT CTAS lists the Clerk & Master at 100 Public Square, County Courthouse, Room 401, Gallatin; confirm the contact location before visiting. A separate Circuit Court Clerk is also listed, and the offices are not interchangeable. A directory listing alone does not establish the correct venue or whether a court proceeding is needed.
If property records are relevant, UT CTAS lists a separate Sumner County Register of Deeds contact at 355 Belvedere Drive, Room 201, Gallatin; confirm before visiting. A recorded document does not by itself establish ownership or determine the right transfer or court process. Dale Law Group, PLLC serves Tennessee from its Murfreesboro office. A practical next step is to identify the decision at hand, collect existing documents and ask which authority, planning tool or administration path fits the circumstances.
Questions to bring to the discussion
Does having a will mean probate is unnecessary?
A will is an important planning document, but its existence alone does not determine whether probate or another administration process is appropriate. The will, property arrangements and other relevant documents need to be considered.
Can a financial power of attorney make healthcare decisions?
Do not assume so. A power of attorney’s scope and limits matter. Financial authority, healthcare decision-making, healthcare preferences and access to medical information are distinct issues addressed through different documents and roles.
