Trust Administration
Trust Administration in Hickman
A trustee’s first task is not to distribute assets—it is to establish what the trust says, what property is actually held in the trust, and what authority the trustee has. Dale Law Group, PLLC offers trust administration services to people in Hickman and throughout Tennessee. The firm’s office is in Murfreesboro; Hickman is an unincorporated Census-designated place, not a separate city government.
Start with authority, not assumptions
Gather the trust instrument and any amendments, then identify who is serving as trustee and what decisions the document assigns to that role. A trustee’s authority comes from the trust terms and is not interchangeable with an executor’s authority under a will or an agent’s authority under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration and limits matter; it does not automatically make that person trustee.
If someone has asked you to act, compare the request with the documents before taking action. Note any missing instrument or amendment, uncertainty about who may act, or unclear direction about a particular asset. Resolve those questions before treating an account or property as available for a distribution.
- Separate documents by role: trust and amendments; will and executor matters; power of attorney and agent authority.
- Record the name of each relevant account or asset and the document that appears to establish its ownership or authority.
Match the trust terms to the assets
Prepare an asset-and-account inventory showing the institution or property, how it is titled, the available statement or record, and any question that remains. A trust document alone does not establish that every asset is owned by the trust. For each proposed transfer or distribution, compare the trust’s instructions with the ownership information you can verify.
For land, keep the deed or other available ownership record with the trust documents. The University of Tennessee County Technical Assistance Service lists a separate Smith County Register of Deeds contact at 122 Turner High Circle, Suite 113, Carthage, TN 37030. This is a directory contact address, not a determination of ownership or the right transfer process; confirm the location before visiting. A recorded document by itself does not guarantee clear title.
- Track: asset, current title, supporting record, relevant trust direction, and unresolved question.
- Do not assume an account belongs to the trust merely because the trust names it or a family member expects it to pass a certain way.
Use a distribution log before paying or transferring
For each proposed distribution, make a dated entry stating the trust provision you believe applies, the asset or funds involved, the intended recipient, the information supporting the decision, and what remains to be confirmed. Keep copies of statements, correspondence and instructions with the entry. This creates a practical review trail and helps distinguish a direction in the trust from a request made by a beneficiary or another person.
If the trust’s authority, asset ownership, recipient, or requested action is unclear, mark the item as unresolved rather than recording it as approved. Trust administration can include reviewing trust terms and proposed distributions; Dale Law Group, PLLC also offers estate-planning services such as revocable and irrevocable trusts.
Keep tax questions tied to the particular trust
Do not infer tax treatment from the word “trust” or from a trust’s name. Federal income-tax reporting depends on the trust: grantor-trust treatment and separate-entity treatment differ. Gather the trust instrument, relevant account and income records, and any prior trust tax filings available to you, then identify questions about reporting or filing responsibilities for the trust at issue.
The IRS instructions for Form 1041 describe trust income-tax reporting, but the appropriate treatment depends on the trust’s circumstances. Ask what information is needed to assess the trust’s reporting obligations rather than assuming that the trustee’s personal tax treatment answers the question.
Questions to bring to the discussion
Is a trustee the same as an executor or power-of-attorney agent?
No. These are distinct roles with different sources of authority. Identify the governing document and the specific authority it grants before acting.
What should I bring to a trust-administration discussion?
Bring the trust and amendments, a list of assets with available title or account records, proposed distribution requests, and any prior trust tax filings or correspondence. Mark what is missing or uncertain.
