Trust administration
Trust Administration in Adams
A trustee’s first task is not simply to distribute assets. It is to establish what the trust authorizes, which property is actually held by or associated with the trust, and what information is still missing. Dale Law Group, PLLC offers trust administration services for people in Adams and throughout Tennessee.
Start with authority, not assumptions
Trustee authority comes from the trust and the trustee’s role. It is not interchangeable with authority held by an executor under a will or by an agent named in a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not automatically give that person trustee powers.
Before taking action, gather the trust document and any amendments, records identifying the current trustee, and communications or other documents that may affect the trustee’s role. If a document is missing or the trustee’s authority is unclear, identify the gap and resolve it before treating a proposed transaction as authorized.
Compare trust terms with asset records
A trust’s name on a document does not, by itself, establish how an account or other asset is owned. Compare the trust’s terms with account statements, ownership records, and relevant transfer documents. Note inconsistencies rather than assuming the trust controls an asset simply because it is mentioned in family records or prior planning papers.
For land in Robertson County, the Register of Deeds directory identifies a separate county land-record contact. A directory listing or recorded document does not establish ownership, guarantee clear title, or determine which transfer or court procedure is appropriate. Confirm what the records show before relying on them in administration.
Use a distribution log before making payments
Create a working distribution log for each proposed payment or transfer. Record the asset, proposed recipient, amount or property, the trust provision that appears relevant, supporting records, questions still open, and the action taken. Keep the proposal separate from completed transactions so that unresolved items remain visible.
This makes it easier to compare a proposed distribution with the trust’s terms and available account information. If an ownership record conflicts with the trust paperwork, or a key document is absent, mark the item as pending rather than treating a proposed distribution as approved.
Keep tax treatment tied to the particular trust
Trust income-tax treatment and reporting depend on the trust. Grantor-trust treatment and separate-entity treatment differ, and the label “trust” alone does not determine the tax result. Collect the trust documents and relevant income and account records, then identify tax questions that need to be answered for this trust rather than assuming a generic rule applies.
Dale Law Group, PLLC provides trust administration services. The administration review can help organize the authority, ownership, distribution, and tax questions that need attention.
Prepare for a focused review
Bring the trust and amendments, records showing who is serving as trustee, current statements or ownership records for trust-related assets, and a list of proposed distributions. Add a short missing-document list and your distribution log, even if some entries are incomplete.
Useful questions include: Which document establishes the current trustee’s authority? Does the trust appear to own each asset proposed for administration? What support is needed before a distribution is made? Which items require clarification before further action?
Questions to bring to the discussion
Does a power of attorney make someone the trustee?
Not by itself. A power of attorney gives an agent authority within the document’s scope and limits; trustee authority is a distinct role. Identify the document and role before acting.
Does the trust’s name on paperwork prove that an asset belongs to it?
No. Compare the trust terms with the asset’s ownership and account records. If the documents conflict or are incomplete, resolve that uncertainty before relying on the asset in administration.
