Trust Administration
Trust Administration in Hilham
Being named trustee does not make you an executor or an agent under a power of attorney. Your authority depends on the trust and your role. Dale Law Group, PLLC offers trust-administration services to clients in Tennessee, including Hilham and Overton County.
Start with authority, not assumptions
A trustee’s responsibilities come from the trust and the assets held in it. An executor’s authority and an agent’s authority under a power of attorney arise from different roles and documents. Do not treat one document as permission to act in another capacity.
Before moving money or making a distribution, identify the trust, confirm who is serving as trustee, and review the provisions that apply to the decision. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not automatically confer trustee authority.
Compare the trust terms with account ownership
Make an asset-by-asset list and compare it with available account statements, deeds, and other ownership records. Ask whether each asset appears to be owned by the trust, is held in another name, or has a beneficiary designation that may affect how it passes. The trust’s name alone does not establish how every asset is owned or determine the tax treatment.
If real estate is involved, a recorded document or a land-record directory contact does not by itself establish ownership, clear title, or the appropriate transfer. The Overton County Register of Deeds directory lists a contact address at 306 West Main St, Livingston, TN 38570; confirm the location before visiting.
Use a decision log before distributions
Create a simple log for each proposed distribution: the asset, its ownership as currently documented, the trust provision you believe applies, the proposed recipient and amount or property, supporting records, and any unanswered question. Keep the source documents with the entry and note whether the action is pending or completed.
This makes it easier to pause when the trust terms, account ownership, or supporting records do not line up. It also gives an adviser a focused record to review before you act, rather than relying on memory or treating a beneficiary’s request as authorization.
Prepare for a focused review
Gather the trust and any amendments, documents showing who is serving as trustee, current statements for trust-related accounts, deeds or other ownership records, and a list of proposed distributions. Include correspondence or records that explain a disputed, incomplete, or unclear item.
Useful questions include: Which trust provision governs this proposed payment? Does the asset appear to be titled in the trust? What additional record would resolve the mismatch? Is the trustee acting under the trust, or is someone invoking a separate power of attorney? What tax reporting questions should be addressed? Trust income-tax treatment depends on the trust; grantor-trust and separate-entity treatment differ, so the trust’s label alone does not determine the result.
Local contacts and next steps
Hilham is an unincorporated Census-designated place in Overton County, not a separate municipal government. Dale Law Group, PLLC’s office is in Murfreesboro; the firm serves clients across Tennessee.
For land-record contact information, UT CTAS lists the Overton County Register of Deeds at 306 West Main St, Livingston, TN 38570. A directory address may be a mailing or contact address, so confirm before visiting. Court-office listings do not establish whether a proceeding is necessary, the correct venue, or a required filing.
Questions to bring to the discussion
Can I use a power of attorney to make a trust distribution?
Not simply because you hold a power of attorney. That document’s scope and limits govern authority to act for another person; trustee authority comes from the trust and the trustee’s role. Identify which capacity applies before acting.
Does a trust’s name tell me how it is taxed?
No. Tax treatment and reporting depend on the trust. Grantor-trust and separate-entity treatment differ, so the trust label alone does not determine the tax result.
