Special Needs Trusts in Hilham

A special needs trust plan is not only a choice of trust. It also requires decisions about whose funds will be contributed, who will manage them, what support the trust should provide and how distributions may interact with SSI. These questions can help organize a planning conversation without assuming a particular trust will preserve benefits.

Start with the source of the funds

Identify whose money may go into the trust and how it may arrive—for example, through a planned contribution or an inheritance. The source matters to the design discussion; do not assume different sources can use identical terms or that every trust receives the same treatment for SSI.

Bring a simple funds map: the person who owns or expects to receive the funds, the likely source, an approximate amount if known, and any documents or decisions that could affect the transfer. This is a planning aid, not a conclusion about eligibility.

Compare the support goal with the distribution choice

Write down the intended support before deciding how the trustee might pay for it. Then distinguish money paid directly to the beneficiary from a purchase made by the trust and from help with shelter. They are not interchangeable for SSI purposes.

SSA explains that trust ownership, terms and payments can affect SSI, and not every trust is excluded. It also distinguishes food provided in kind from cash or gift cards for food: food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or food gift cards may count as unearned income. Help with shelter can affect SSI. Ask how a proposed payment should be evaluated before treating it as harmless or equivalent to another form of support.

      Prepare a practical comparison sheet

For each likely expense, record the purpose, who would receive payment, whether the trust would pay a provider or give money to the beneficiary, and whether the expense involves food or shelter. Add the benefit or support question you want answered. This lets you compare intended support with possible payment methods without presuming the result.

Gather current benefit notices or other benefit correspondence, information about the source and ownership of funds, and any existing trust or estate documents that may direct assets. Keep originals secure and bring copies for discussion.

Clarify who may act and what to ask

A trustee, an agent under a power of attorney, a court-appointed guardian or conservator, and a government-appointed benefit fiduciary are distinct roles. CFPB guidance emphasizes identifying the role and its authority rather than assuming one person or document covers every decision. A power of attorney’s scope, duration and limits matter; it does not automatically grant every power.

Useful questions include: What source of funds is the proposed trust meant to receive? Which support goals should its terms address? Who would manage trust assets, and what decisions would that role authorize? How should the family evaluate cash, food, shelter and direct purchases before a distribution? What benefit notices or changes should be reviewed when considering payments? Dale Law Group, PLLC offers special needs trust planning as part of its Tennessee estate-planning services. The firm’s office is in Murfreesboro; Hilham is an unincorporated Census-designated place in Overton County, not a separate municipal government.

Questions to bring to the discussion

Does creating a special needs trust guarantee SSI eligibility?

No. SSA states that trust ownership, terms and payments can affect SSI, and does not say every trust is excluded. The trust and proposed distributions need to be considered in light of the person’s circumstances.

Are cash, food and shelter treated alike for SSI?

No. SSA states that food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or gift cards for food may count as unearned income; help with shelter can affect SSI. Do not assume a cash payment, a purchase or shelter support has the same effect.
