Wills in Woodland Mills
A will records your instructions, but it is not the only document or ownership arrangement that may affect what happens to property. Before drafting or revising one, compare what the will says with how each asset is titled and whether it names a beneficiary.
Compare instructions with ownership and beneficiary records
Start by sorting assets into three groups: items you expect your will to address, items held jointly, and accounts or policies with a beneficiary designation. The will’s instructions should be considered alongside the other records; do not assume a will changes the owner or beneficiary listed elsewhere.
For example, if a will names one person to receive an item but an account record names someone else, flag the difference for review rather than assuming which instruction controls. The same comparison can reveal outdated names, unclear descriptions, or property that may not be accounted for in the will.
Make a one-page asset and instruction inventory
Before a planning conversation, create a simple inventory with one row for each significant asset. Record its general description, current owner or title as shown on a recent record, any named beneficiary, the person you want to receive it, and the document where that information appears. Note questions instead of trying to resolve uncertain ownership yourself.
Keep copies or locations of the relevant records with the inventory, such as account beneficiary confirmations, deeds, and existing estate-planning documents. Protect account credentials and sensitive identifying information; the inventory can identify documents without listing passwords or full account numbers.
Name the right person for each role
A will can name someone to handle estate matters, while a trustee manages assets held in a trust and an agent under a power of attorney acts under the authority and limits of that document. These roles are not interchangeable. CFPB guidance also distinguishes agents under powers of attorney from court-appointed guardians or conservators and other fiduciaries.
When comparing candidates, consider the task each person would actually perform, whether the person is willing and able to serve, and whether a backup is appropriate. Dale Law Group, PLLC offers wills, trusts, and durable financial powers of attorney, so related documents can be considered as part of the planning discussion.
Resolve property-record questions before relying on assumptions
If a deed or other land record appears inconsistent with your inventory, mark the exact question and bring the document for review. The UT CTAS directory lists a separate Obion County Register of Deeds contact at P.O. Box 514, Union City, TN 38281; confirm current contact and location details before relying on them. A directory listing or recorded document alone does not determine ownership or establish which procedure is appropriate.
Dale Law Group, PLLC is located in Murfreesboro and serves clients across Tennessee; it does not have an additional office in Woodland Mills. For a wills consultation, ask how the will’s instructions should be compared with your ownership and beneficiary records, whether related trust or power-of-attorney documents should be considered, and what information is needed to address any inconsistency.
Questions to bring to the discussion
Does a will control every asset I own?
Do not assume so. Ownership arrangements and beneficiary designations may affect how property passes. Compare those records with the will and flag any conflict for review.
Should I bring deeds and beneficiary information?
Yes, if available. A short inventory with the relevant records or their locations helps identify questions about ownership, named beneficiaries, and the will’s instructions.
