Durable Financial Power of Attorney in Rives

A financial power of attorney is a way to authorize another person to act on your behalf. The practical decisions are who should serve, what financial tasks the agent may handle, and how the document will be shared and presented when needed. Dale Law Group, PLLC offers durable financial power of attorney services to people across Tennessee.

Start with the work you may need handled

List the financial matters for which you want someone to be able to act. Depending on your circumstances, that might include communicating with a financial institution or handling a real-estate document. Then identify any matters you want excluded or any limits you want considered. A power of attorney’s scope, duration and limits matter; do not assume one document grants every power.

Choosing an agent is a separate decision from defining the agent’s authority. Consider whether the person you name can take on the responsibilities you have in mind and whether you want to identify an alternate. An agent under a power of attorney is not the same role as a trustee, a court-appointed guardian or conservator, or a fiduciary appointed for government benefits.

CFPB explains that durable financial authority remains in effect if you become incapacitated. That continuing-authority question is separate from when the agent may begin acting and which tasks the document covers; review the document’s scope and limits as well as the proposed agent.

    Compare authority with access

A document may describe authority, but the people asked to act on it may also need a practical way to review it. Before relying on the document for a particular task, ask the relevant bank, institution or other recipient what it needs to see and how it reviews powers of attorney. Do not assume acceptance by one organization guarantees acceptance everywhere.

If real estate is involved, separate the question of what the agent is authorized to do from questions about the property record or a document that may need to be recorded. The UT CTAS directory lists a separate Obion County Register of Deeds contact at P.O. Box 514, Union City, TN 38281. The address may be a mailing address, so confirm current instructions before visiting. A directory listing or recorded document does not establish ownership, guarantee clear title, or decide which legal process is appropriate.

      Prepare a document-access plan

Bring a one-page task-and-access list to your planning discussion. For each task, note the institution or person involved, the action you anticipate the agent may need to take, any limit you want discussed, and where the signed document or copies will be kept. Add a note about who should know how to locate it. This checklist helps connect the authority you are considering with the situations in which someone may need to present the document.

Ask whether the financial power of attorney should work alongside your other planning documents, and how the agent’s role differs from an executor or trustee. Keep healthcare decisions separate: a healthcare power of attorney or advance healthcare directive addresses healthcare authority and preferences, not the financial tasks assigned in a financial power of attorney.

        Questions to resolve before signing

Ask what powers are included, what limits can be expressed, how the document addresses duration, and what the agent should do if a recipient requests clarification. Ask how you can update your access plan if your chosen agent or financial relationships change. For property-related questions, confirm which office or professional can answer the specific records question; the county directory lists distinct court-office contacts, but those listings alone do not determine a required filing or legal venue.

Questions to bring to the discussion

Does a financial power of attorney also authorize healthcare decisions?

Do not assume so. Financial authority and healthcare authority are distinct; healthcare planning may involve a separate healthcare power of attorney or advance healthcare directive.

Will a bank or other recipient accept the document?

Do not assume every recipient will handle a document the same way. Ask the institution what it requires to review the document and whether it has questions about the agent’s authority.
