Revocable Living Trusts in Bethel Springs
A trust document is only one part of a working plan. The practical questions are which assets are titled in the trust, who can act if you cannot, and who takes over after your death. Dale Law Group, PLLC offers revocable living trust planning to clients across Tennessee; its office is in Murfreesboro.
Start with ownership, not just the document
A revocable living trust sets out terms for managing property held in the trust and names people to carry out those terms. Signing the document alone does not establish that every asset is owned by the trust. Review each asset’s current title and transfer method, then identify which items should be coordinated with the trust and which may pass under other arrangements.
This ownership map is also useful for spotting practical gaps: an asset may still be titled individually, have a beneficiary designation, or require a separate ownership review. Do not assume that a trust name on paperwork, by itself, changes title or determines tax treatment. Trust income-tax reporting depends on the trust’s structure; grantor-trust and separate-entity treatment differ.
IRS guidance describes a revocable living trust as a written arrangement created during life that can be changed or ended during the individual’s life. The agreement, the person responsible for trust management and the assets actually coordinated with it are separate parts of the planning work.
- List each major asset and its current owner or title.
- Note any beneficiary designation or other transfer arrangement you know about.
- Mark questions about whether and how an asset should be coordinated with the trust.
Compare the decision-makers and the documents
Consider the plan in two situations: while you are living but unable to manage financial matters, and after your death. A successor trustee’s authority comes from the trust and applies to trust property. An agent under a power of attorney acts under that separate document, within its stated scope and limits; it is not automatically authority over every asset or a substitute for trustee authority. A court-appointed guardian or conservator is a different role again.
Compare who you have named for each role, what property each person may be able to manage, and whether the documents leave a practical gap. A healthcare agent and healthcare preferences belong in an advance healthcare directive, not in the financial authority granted by a trust or power of attorney.
Prepare an ownership and successor checklist
Before a planning conversation, prepare a simple inventory rather than trying to resolve every title question yourself. For each asset, record the institution or location, the name or names shown on the latest statement or deed, any known beneficiary, and the person you expect to manage it. Bring copies of relevant trust, will, power-of-attorney, and beneficiary documents if available. Keep healthcare documents separate, and flag any mismatch between your intended successor and the person currently named on an account or record.
For real property in McNairy County, a separate Register of Deeds contact is listed in Selmer. A directory listing or recorded document does not establish clear title or determine the appropriate transfer. Confirm current contact information before relying on an office address or planning a visit.
Turn the map into a coordinated plan
Use the checklist to ask which assets should be held in the trust, what steps are needed to coordinate ownership, and what should remain outside it. Ask how successor trustees will identify and manage trust property, how the trust works alongside your will and financial power of attorney, and whether any beneficiary arrangements need separate attention. Also ask how the trust’s tax reporting would be determined for your circumstances.
For Bethel Springs residents, the McNairy County land-record contact is a public records resource, not a legal determination about ownership or the correct procedure. Dale Law Group, PLLC serves Tennessee clients from its Murfreesboro office.
Questions to bring to the discussion
Does signing a revocable living trust automatically transfer my property into it?
No. Signing the trust document alone does not establish that each asset is trust-owned. Review current titles and transfer arrangements and determine what coordination is needed for each asset.
Does a successor trustee replace an agent under my power of attorney?
No. These are distinct roles. A successor trustee acts under the trust with respect to trust property; an agent acts under the power of attorney within its scope and limits. Review both documents together.
