Healthcare Power of Attorney

Healthcare Power of Attorney in Calhoun

A useful healthcare plan answers two different questions: who should speak for you if you cannot communicate, and what guidance should that person have? For Calhoun residents, choosing an agent and preparing that person to act are related but distinct decisions.

Choose for availability as well as trust

Consider whether your preferred agent is likely to be reachable, willing to take on the responsibility, and able to communicate with the people involved in your care. A trusted person who is difficult to contact may not be the most practical first choice. Compare that person with someone who is more available, and decide whom you would want as an alternate if your first choice cannot serve.

The Tennessee Advance Directive for Health Care form addresses an agent or alternate as well as healthcare preferences. The decision is not simply a choice between appointing someone and writing down instructions: you can consider both who should act and what preferences you want to communicate.

  • First choice: Who knows your values and is willing and realistically available?
  • Alternate: Who could step in if your first choice cannot act?
  • Preferences: What guidance would help either person understand your wishes?

Separate decision-making authority from access to information

A healthcare power of attorney concerns decision-making authority. A HIPAA authorization concerns information sharing; by itself, it does not appoint someone to make healthcare decisions. These documents can serve different purposes and should not be treated as interchangeable.

HIPAA’s personal-representative rules recognize that state-law healthcare authority can make someone a personal representative. Whether another information-sharing authorization is useful depends on the situation and the documents involved; do not assume an agent always needs a separate one.

  • Identify which document appoints an agent and which, if any, addresses information sharing.
  • Check that existing instructions and documents use roles consistently rather than assuming one document supplies every kind of authority.

Prepare a one-page agent decision sheet

Before a planning conversation, write down your preferred agent and alternate, why each is a practical choice, how to reach them, and the healthcare preferences you most want them to understand. Add a short list of existing healthcare directives, living-will instructions, and information-sharing authorizations so you can compare their purpose and current status.

This sheet is a preparation aid, not a substitute for the formal document. Tennessee’s Advance Directive for Health Care form includes instructions about signing and sharing copies. Review the applicable form instructions and discuss how to complete and share your documents; this page does not prescribe execution steps.

  • Bring the names and contact details for your proposed agent and alternate.
  • List existing healthcare documents and note who has copies.
  • Write down questions about how your preferences and documents fit together.

Questions to resolve before you finalize a plan

Ask whether the person you have in mind is willing and reachable, what should happen if that person cannot act, and how your healthcare preferences should be expressed. Also ask which existing documents address decision-making and which address information access, and whether any need to be coordinated or updated.

Questions to bring to the discussion

Does a HIPAA authorization appoint my healthcare decision-maker?

No. An information-sharing authorization alone does not appoint a healthcare decision-maker. State-law healthcare authority can make someone a HIPAA personal representative, so consider the purpose of each document rather than assuming they are interchangeable.

    Why name an alternate agent?

An alternate gives you another person to consider if your first choice cannot act. Compare both people for willingness, availability, and ability to understand your preferences.
