Special Needs Trusts in Mercer
A special needs trust plan involves more than choosing a trust. The source of the money, who will manage it, what the trust permits, and how support is provided are separate questions. For someone receiving Supplemental Security Income (SSI), those details matter: trust ownership, terms, and payments can affect SSI, and no trust should be assumed to preserve eligibility in every situation.
Start with the support plan and the money
Write down the support the beneficiary may need and the funds that might be contributed. For example, distinguish money already belonging to the beneficiary from money another person may contribute. Record what is known about each source rather than treating all funds as interchangeable. The source can be important to the planning discussion, but it does not by itself establish how a trust will be treated.
Then separate the intended purpose of the trust from the questions about benefits. A plan should make clear who is expected to manage funds, what kinds of support are contemplated, and how decisions and records will be handled. The trust’s terms and actual payments matter; a label alone is not a benefits determination.
Compare distribution choices before settling on terms
Consider the difference between cash, purchases, and help with shelter. SSI treats these differently in some circumstances: food provided in kind is excluded from SSI’s support-and-maintenance calculations, while cash or gift cards for food may count as unearned income. Help with shelter can affect SSI. That is a reason to ask how a proposed payment would work in practice, not to assume that every food-related payment—or every trust distribution—has the same effect.
A useful comparison is to list each intended expense, how it might be paid, who would arrange the purchase or service, and what records would be kept. Ask how that approach fits the trust terms and whether it could affect SSI. Do not rely on a general promise that a trust or a particular type of purchase will preserve benefits.
Bring a one-page planning worksheet
Before a conversation, prepare a simple worksheet with four headings: anticipated support; possible sources and approximate amounts of funds; people who may be involved in managing or receiving funds; and questions about SSI or other benefits. Under support, separate food, shelter, services, and other intended purchases. Mark any uncertain item as a question rather than making an assumption.
Bring relevant trust or benefit documents if available, along with a list of current decision-making arrangements. Identify whether a person acts under a power of attorney, is a court-appointed guardian or conservator, serves as trustee, or has another role. These authorities are not interchangeable, and a power of attorney’s scope, duration, and limits depend on the document.
Questions to resolve with counsel
Ask what trust structure and terms fit the beneficiary’s circumstances and proposed source of funds; who would serve as trustee and what decisions that role involves; how planned distributions should be evaluated for SSI; and what notices, records, or coordination may be needed when benefits or circumstances change. Also ask how the plan should be revisited if the beneficiary’s needs, assets, or support arrangements change.

Questions to bring to the discussion
Does having a trust guarantee SSI eligibility?
No. Trust ownership, terms, and payments can affect SSI, and not every trust is excluded. Have the specific arrangement reviewed in light of the beneficiary’s circumstances.
Are cash, food purchases, and shelter treated the same for SSI?
No. Food provided in kind is excluded from SSI support-and-maintenance calculations; cash or gift cards for food may count as unearned income, and help with shelter can affect SSI. Consider the actual payment arrangement rather than assuming the categories are equivalent.
