Trust Administration

Trust Administration in Lenoir City

Being named trustee does not make you an executor, an agent under a power of attorney, or the owner of trust property. Start by confirming which document gives you authority, what property it covers, and what the trust says before moving or distributing assets.

Confirm your role and the trust’s reach

Gather the signed trust and any amendments, then identify who is serving as trustee and the provisions that govern administration. A power of attorney authorizes an agent to act for another person within the document’s scope; trustee authority comes from the trust. Neither role automatically gives the person authority belonging to an executor or another fiduciary.

Compare the trust’s terms with current account statements, deeds, and other ownership records. A trust’s name alone does not establish that a particular account or property is held by the trust. If ownership, authority, or a missing document is unclear, pause before taking action and determine what needs to be confirmed.

Use an administration ledger before distributions

Create one working ledger with a line for each asset or proposed payment. Record the source document, the named owner or account holder, the relevant trust provision, the proposed action, and what remains unverified. This gives you a practical way to separate documented authority from assumptions and track questions as they are resolved.

For a proposed distribution, note the recipient, amount or property, reason under the trust, supporting records, and status: ready for review, awaiting information, or on hold. Do not treat a proposed distribution as authorized just because a beneficiary has requested it. Compare it with the trust terms and the records before proceeding.

    • Collect the trust and amendments; account statements and ownership records; relevant correspondence; and a list of proposed expenses or distributions.
    • Mark missing or conflicting information explicitly rather than filling gaps with assumptions.
    • Keep a record of the provision and document supporting each action.

Separate administration from tax reporting and other roles

Trust income-tax treatment and reporting depend on the trust. Grantor-trust treatment and separate-entity treatment differ, so the trust label by itself does not determine the tax result. Keep tax questions distinct from the question of whether the trust authorizes a particular transaction.

A person may hold more than one role, but the documents and scope still matter. A financial power of attorney does not automatically grant every power, and it is not a substitute for trustee authority. If a court-appointed guardian or conservator, trustee, agent, or other fiduciary is involved, identify the role and document before relying on that person’s authority.

      Questions to resolve before acting

For a Lenoir City matter involving land records, a directory can help identify a Loudon County Register of Deeds contact, but a recorded document or directory listing does not determine ownership or which transfer is appropriate. Confirm current contact instructions before relying on an office listing.

Bring the ledger and ask: Which trust provisions govern this asset or payment? Do the ownership records match the trust’s terms? What information is still needed before deciding? Does a tax-reporting question require separate attention? Dale Law Group, PLLC offers trust-administration services to clients across Tennessee; its only listed office is in Murfreesboro.

Questions to bring to the discussion

Can I distribute property because the person named in the trust requested it?

A request alone does not establish that a distribution is authorized. Check the trust terms, the trustee’s authority, and the records supporting the proposed action; hold unresolved items for review.

Does a power of attorney let someone administer a trust?

Not automatically. A power of attorney authorizes an agent within the document’s scope, while trustee authority comes from the trust. Identify the role and governing document before acting.
