Revocable Living Trusts in Tennessee Ridge

A trust document is only one part of a plan. The practical questions are which assets are intended to be held by the trust, who can act under each document, and how those arrangements fit together. Dale Law Group, PLLC, serves clients across Tennessee from its Murfreesboro office.

Start with ownership, not just the document

A signed trust does not, by itself, show how every asset is currently owned or how it should be handled. Begin by listing each asset, its current owner or account holder, any named beneficiary, and the document or institution that controls access. Then mark whether you believe it should be considered for trust ownership, remain outside the trust, or needs further review.

That working inventory helps identify the coordination questions to resolve before relying on the plan. For real estate, note the property address and gather available deed or title records; a recorded document or a land-record directory contact does not, on its own, establish clear title or determine the appropriate transfer.

IRS guidance describes a revocable living trust as a written arrangement created during life that can be changed or ended during the individual’s life. The agreement, the person responsible for trust management and the assets actually coordinated with it are separate parts of the planning work.

  • List real estate, financial accounts, business interests, and other significant property.
  • Record account or deed names and beneficiary designations as they appear in current records.
  • Flag assets with unclear ownership, pending changes, or instructions that may conflict.

Compare the decision-making arrangements

A useful comparison is not simply “trust or no trust.” It is which arrangement addresses each task and when. A trustee’s authority comes from the trust and concerns trust matters; an agent under a power of attorney acts under that separate document. A court-appointed guardian or conservator and a government-appointed benefit fiduciary are different roles again. Do not assume one person or document automatically supplies every authority.

Review who is expected to act, what property or decisions the role covers, and what limits or duration apply. A durable financial power of attorney may address matters outside the trust, but its scope depends on the document. Healthcare decisions belong in the healthcare planning documents, not in assumptions about a financial role.

  • Identify the proposed trustee and successor, and the circumstances in which each is expected to act.
  • Compare trust authority with the scope and limits of any financial power of attorney.
  • Keep healthcare agents and preferences in the applicable advance healthcare directive.

Build a coordination checklist

Bring the current trust and amendments, will, powers of attorney, healthcare directive, account statements, beneficiary records, and available deeds. For each asset, note the current ownership, intended arrangement, and the question that remains. This is a practical way to review whether documents and asset records tell a consistent story, rather than treating signing as the last step.

For Houston County property-record contact information, the Register of Deeds directory lists a contact at P.O. Box 412, Erin, Tennessee 37061. Confirm current instructions before relying on that address or visiting. The directory is a contact resource, not a determination of ownership or which procedure is appropriate.

  • Ask which assets, if any, should be retitled and what records would verify a completed change.
  • Ask how beneficiary designations should be reviewed alongside the trust.
  • Ask what the successor trustee may handle, and what requires a separate agent or other authority.
  • Ask how the trust’s intended tax reporting should be determined; tax treatment depends on the trust, not its label alone.

Review the plan as a connected set

Trust income-tax treatment and reporting can differ depending on the trust, including whether grantor-trust or separate-entity treatment applies. Do not infer a tax result from the name of the document. A review can address the trust terms, the asset inventory, related documents, and the questions that remain about ownership and reporting.

Questions to bring to the discussion

Does signing a revocable living trust automatically place my assets in it?

No. The document alone does not establish that each asset is held by the trust. Review ownership records, beneficiary designations, and any needed follow-up for each asset.

Can a successor trustee use my financial power of attorney or make healthcare decisions?

Those are distinct roles. A trustee acts under the trust, an agent acts under a power of attorney within its scope, and healthcare authority is addressed through healthcare planning documents. Review each document rather than assuming one role includes another.
