Trust Administration in Lyles

A trust’s instructions, the way assets are titled, and the person’s role each matter when administering a trust. Dale Law Group, PLLC assists Tennessee clients with trust administration, including reviewing trust terms, organizing records, and addressing proposed distributions.

Start with authority and ownership

Before acting, identify the trust document and any amendments, determine who is serving as trustee, and review what the trust says about that role. A trustee’s authority is not interchangeable with an executor’s authority under a will or an agent’s authority under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not automatically make the agent a trustee.

Then make an asset inventory that records how each asset is titled, which trust or person appears as owner, and any known beneficiary designation. Trust language alone does not establish that every asset is owned by the trust. Keep questions about ownership and access separate from decisions about whether a proposed distribution is permitted.

    Compare the decision before distributing

For each proposed distribution, compare the request with the trust’s terms and the records for the relevant asset. Note the proposed recipient, amount or property, purpose, supporting documents, and the provision you believe applies. If the ownership record, beneficiary information, trustee authority, or trust language is unclear, mark the issue for resolution rather than treating a request or account label as approval.

This comparison also helps distinguish administration from tax reporting. Trust income-tax treatment depends on the trust; grantor-trust and separate-entity treatment differ. The trust’s name or general label alone does not settle its tax treatment or reporting.

Prepare a working record before taking action

Create a trust administration worksheet with one row for each asset and one for each proposed distribution. For assets, record the institution or property description, title or ownership information, available account statements or deeds, beneficiary information, and any missing document. For distributions, record the request, the trust provision under consideration, supporting information, the decision status, and the date of any action. Keep copies of the trust and amendments with the worksheet, and update it as records are confirmed.

      • Gather the complete trust document and amendments, trustee appointment or acceptance records if available, recent statements, deeds or other ownership records, beneficiary information, and correspondence about requested distributions.
      • Separate confirmed information from open questions; do not assume that possession of a document or account information establishes authority to act.

Local records and practical next steps

Lyles is an unincorporated Census-designated place in Hickman County, not a separate city government. When a trust asset involves land, the Hickman County Register of Deeds directory lists a contact address at 114 North Central Avenue, Suite 104, Centerville. Confirm the location before visiting. A directory contact or recorded document does not determine ownership, guarantee clear title, or establish which transfer or court procedure is appropriate.

Dale Law Group, PLLC serves clients across Tennessee from its Murfreesboro office. For a trust-administration discussion, bring the worksheet and ask: Who has authority under these documents? Which assets appear to belong to the trust? What additional records are needed before a distribution decision? Which unresolved issues may affect reporting or administration?

Questions to bring to the discussion

Can an agent under a power of attorney administer a trust?

Not simply because the person holds a power of attorney. A power of attorney and a trustee role are different authorities, and the document’s scope, duration, and limits matter. Identify the relevant documents and role before acting.

Does putting a trust name on an account settle its tax treatment?

No. Trust income-tax treatment and reporting depend on the trust, and grantor-trust and separate-entity treatment differ. The trust label alone does not determine the result.
