Trust Administration

Trust Administration in Huron

Serving as trustee is a distinct responsibility: the trust document, the assets actually held in the trust, and the trustee’s authority all need to be considered together. Dale Law Group, PLLC offers trust-administration services to clients in Huron, an unincorporated community in Henderson County.

Start by identifying the role and authority

A trustee’s authority comes from the trust and the trustee’s role under it. That is not automatically the same as authority held by an executor administering an estate or an agent acting under a power of attorney. A power of attorney’s scope, duration and limits depend on the document; it should not be treated as permission to make every financial decision.

Before taking action, gather the complete trust document and any amendments, documents identifying the current trustee, and any related authority documents. Clarify who is asking you to act, in what capacity, and which property the request concerns. If a document or role is unclear, pause the proposed action until that question is resolved.

Match the trust terms to the asset records

A trust’s name on paperwork does not, by itself, establish how every asset is owned or how its income is treated for tax purposes. Compare the trust terms with account statements, ownership or title records, and other available asset documents. Record the asset, the name shown on its records, the date of the record, and any difference you need to investigate.

This comparison helps separate questions about what the trust authorizes from questions about whether an asset is held in the trust. Trust income-tax reporting also depends on the trust’s tax treatment; grantor-trust and separate-entity treatment differ. A trust label alone does not determine the tax result.

Use a distribution log before money moves

Create a simple proposed-distribution log as your first working record. For each proposed payment or transfer, note the date considered, recipient, amount or property, stated purpose, trust provision you believe applies, supporting documents, and whether the item is approved, deferred or awaiting clarification. Keep the related request and records together.

Use the log to compare the proposed action with the trust’s terms and the asset information—not as a substitute for either. It can expose missing documents, inconsistent ownership information, or an unresolved question about the trustee’s authority before you act. Ask: Which provision supports this distribution? What records confirm the asset and its ownership? Is there a restriction or condition I have not resolved?

Resolve records and reporting questions deliberately

For a trust that includes real property, distinguish the trust-administration question from the question of what land records show. Henderson County’s Register of Deeds contact is listed at 17 Monroe Avenue, Suite 5, Lexington, Tennessee 38351. Confirm the contact location before visiting. A directory listing or recorded document does not by itself establish ownership, clear title, or the appropriate transfer or court procedure.

If a proceeding or filing may be involved, first clarify what is required rather than assuming a particular county office determines the answer. Henderson County listings identify separate Clerk & Master and Circuit Court Clerk contacts; the offices are not interchangeable, and a contact listing alone does not establish the correct venue or whether a proceeding is necessary.

Prepare for a focused administration review

Bring the trust and amendments, current trustee information, asset and account records, relevant correspondence, and your distribution log. Identify decisions already made, decisions still pending, and records you cannot locate. Dale Law Group, PLLC can assist with trust administration and related planning questions. Its office is in Murfreesboro; Huron is not a separate firm office.

Questions to bring to the discussion

Can I use a power of attorney to act as trustee?

Do not assume so. A power of attorney and a trustee’s authority are different roles. Review the documents to determine their scope and who is authorized to act in the matter at hand.

Does a trust name on an account settle how its income is reported?

No. Tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ. Review the trust and account information before drawing a conclusion.
