Trust Administration Lawyers in Olivet TN

Being named trustee does not, by itself, answer what you may do with each asset or when a distribution is appropriate. Administration starts by matching the trust’s terms to the property it actually owns, confirming your authority, and keeping a record of decisions before money or property changes hands.

Separate the trustee role from other roles

A trustee acts under the trust instrument. An executor or personal representative handles responsibilities under a will or estate proceeding, while an agent acts under a power of attorney within that document’s scope, duration, and limits. These roles are not interchangeable, and a person’s authority in one role does not automatically establish authority in another.

Before taking action, identify the trust and any amendments, confirm who is serving as trustee, and check the provisions that address management, distributions, successor trustees, and termination. If another person is also handling an estate or acting as an agent, keep each person’s authority and records distinct.

Compare the trust terms with the asset records

A useful first working document is an asset-and-authority schedule: list each known account or property, how it is titled, the record or statement supporting that information, and the trust provision that appears relevant. Mark gaps rather than assuming that an asset belongs to the trust because the trust names it or because someone intended to transfer it.

For each item, note the institution or record source, the date reviewed, any beneficiary or ownership information shown, and the follow-up needed. For real property, gather the deed and related records. UT CTAS lists a separate Hardin County Register of Deeds contact in Savannah; confirm current contact and location information before relying on a directory listing. A recorded document or directory contact does not, by itself, settle ownership or determine the appropriate transfer or court procedure.

Log proposed distributions before making them

Keep a distribution log alongside the asset schedule. For each proposed payment or transfer, record the amount or property, intended recipient, reason, trust provision considered, supporting documents, questions still open, and whether the action has been completed. This creates a practical pause point when the terms, ownership record, or authority are unclear.

Compare the proposed distribution with the trust’s instructions and the information available about the asset and recipient. If a document is missing, terms appear inconsistent, or the trustee’s authority is uncertain, flag the issue and gather the missing information before acting. Do not use an executor’s or agent’s document as a substitute for trust authority.

        Organize records and tax questions

Keep the trust instrument and amendments, trustee appointment or succession records, account statements, deeds, correspondence, receipts, and the asset and distribution logs together. Track which records are originals, which are copies, and who has been asked to provide missing items.

Trust income-tax treatment and reporting depend on the trust. Grantor-trust treatment and separate-entity treatment differ; the trust’s label alone does not determine the tax result. Gather relevant income and expense records and identify the trust’s tax classification as a question to resolve for the particular trust rather than assuming a filing approach.

Questions to bring to a planning conversation

Dale Law Group, PLLC, offers trust administration services to clients in Tennessee. For an initial discussion, bring the trust and amendments, a list of known assets and their ownership records, any available trustee-transition documents, and your current log of proposed distributions or unresolved requests.

Useful questions include: Which trust provisions control this decision? What evidence is needed to confirm that an asset is held by the trust? Which documents are missing, and who can provide them? What tax reporting questions arise for this trust? If an asset or dispute may involve a court or county record, which office or procedure should be confirmed for the specific issue? Hardin County office listings identify different roles; a contact listing alone does not establish the correct venue or whether a proceeding is necessary.

Questions to bring to the discussion

Does being named in a power of attorney make someone the trustee?

No. A power of attorney authorizes an agent to act for another person within the document’s scope and limits. Trustee authority comes from the trust and the applicable trustee appointment or succession provisions.

Does the trust’s name determine how its income is reported?

No. Tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ. The trust label alone does not establish the result.
