Trust Administration in Tusculum

A trustee’s next step depends on the trust terms and what the trust actually owns—not simply on a person’s role in the family or the name on a document. Dale Law Group, PLLC offers trust administration services to clients in Tennessee, including Tusculum and Greene County.

Start with authority and ownership

Before moving money or making a distribution, identify the acting trustee and review the trust document and any amendments. Then compare that authority with the ownership records for each account or asset. A trust document alone does not establish that every asset is held by the trust.

Keep roles separate. A trustee acts under the trust’s terms; an executor’s authority concerns an estate, while an agent under a power of attorney acts for another person within the document’s scope, duration, and limits. One person may hold more than one role, but that does not make the powers interchangeable.

    Make a working administration record

A useful first step is a dated authority-and-assets worksheet. For each item, note its current owner or account title, the document that supports the trustee’s authority, the institution or custodian to contact, and what remains unverified. Keep proposed actions separate from completed transactions.

Use a distribution log before funds or property are transferred. Record the request, the relevant trust provision, the information still needed, the decision and its basis, and the date and amount of any completed distribution. This creates a practical way to pause when ownership, authority, or the terms are unclear.

    • Gather the trust and amendments, available account statements, deeds or other ownership records, and relevant correspondence.
    • List income, expenses, assets, debts, and proposed distributions without treating an estimate as a verified balance.
    • Mark missing documents and unresolved questions rather than filling gaps with assumptions.

Compare the trust with the asset records

For each asset, ask whether it is titled in the trust, payable or transferable under a separate designation, or apparently owned individually. Those categories can call for different follow-up; the trust’s label does not by itself answer how an asset should be handled. If an asset appears to be outside the trust, pause before treating it as available for a trust distribution.

If administration involves land in Greene County, a deed or directory listing does not settle ownership or determine the correct transfer or court procedure. UT CTAS lists a separate Greene County Register of Deeds contact at 401 Takoma Ave, Suite 105, Greeneville, TN 37743. Confirm current contact and location details before relying on them; a recorded document or directory contact is not a title determination.

      Resolve reporting and next-step questions

Trust income-tax reporting depends on the trust’s tax treatment. Grantor-trust treatment and separate-entity treatment differ, and the word “trust” alone does not determine the result. Identify the trust’s tax reporting history and ask which records or professional input are needed before preparing or relying on a filing.

Dale Law Group, PLLC offers trust administration services. An initial discussion can focus on the governing documents, the asset worksheet, proposed distributions, and specific questions that remain unresolved.

      • Who has authority to act now, and what document supports that authority?
      • Which assets are actually owned by the trust, and what evidence confirms each title?
      • What trust provision supports a proposed distribution, and what information is missing?
      • What tax reporting treatment applies to this trust?

Questions to bring to the discussion

Can an agent under a power of attorney administer a trust?

A power of attorney authorizes action on someone else’s behalf, subject to its scope, duration, and limits. It is not the same role as trustee authority. Review the relevant documents rather than assuming one role grants the other’s powers.

Does every asset connected to a trust belong in its administration?

Not necessarily. Compare the trust terms with account titles, deeds, and other ownership records. If an asset’s ownership or transfer route is uncertain, document the question and resolve it before treating the asset as available for a trust distribution.
