Trust Administration in Milan

Serving as trustee does not make you an executor or an agent under someone’s power of attorney. Before moving money or making a distribution, identify the trust that governs the asset, confirm your authority under its terms, and record what you know and what remains uncertain.

Start with authority, not assumptions

A trustee’s authority comes from the trust and applies to the property held under it. An executor’s role concerns estate administration; an agent’s authority comes from a power of attorney and depends on that document’s scope, duration, and limits. These roles are not interchangeable. A family member’s access to accounts or a separate power of attorney does not, by itself, answer what the trustee may do with trust property.

First compare the trust document and any amendments with the account or property records. Check whose name owns each asset and whether the trust is identified. If the records do not match your understanding, pause before treating the asset as trust property or distributing it.

    Build a working trust-and-assets record

A practical first step is a dated inventory that links each asset to the record supporting its ownership. Keep the trust and amendments, account statements, property records, correspondence, and notes of decisions together. For each proposed payment or distribution, record the request, the relevant trust language, the asset or account involved, supporting documents, and the action taken or question still open.

This record helps distinguish a trust instruction from a beneficiary request and makes unresolved ownership or authority issues visible. Do not treat a recorded document or a directory listing as proof that title is clear or that a particular transfer is appropriate.

    • List assets, current account or title name, and the record reviewed.
    • Identify the trust provision relevant to each proposed action.
    • Note missing documents, conflicting names, and questions to resolve before acting.

Compare the decision paths before distributing

If the trust terms and ownership records align, document the proposed administration step and the basis for it before proceeding. If they conflict, or a document is missing, separate what is confirmed from what is uncertain; avoid assuming that a beneficiary designation, will, or power of attorney changes the trust’s terms. A distribution decision should be tied to the applicable trust provision and the property actually held by the trust.

Tax reporting is another distinct question. The IRS explains that grantor-trust treatment and separate-entity treatment differ; the word “trust” alone does not determine income-tax reporting. Keep tax questions separate from the trustee’s authority and distribution analysis, and identify the trust’s tax treatment with appropriate assistance.

Questions to resolve in a review

When seeking guidance, bring the trust and amendments, current statements or title records, prior administration records, and the inventory of proposed actions. Ask: Which assets are confirmed as trust property? What authority applies to each proposed payment or distribution? What additional document or clarification is needed before acting? What tax reporting treatment applies to this trust, and what records should be retained?

Dale Law Group, PLLC offers trust-administration services to clients in Tennessee. The firm’s office is in Murfreesboro; Milan is a municipality in Gibson County, and no Milan office is identified here. For Gibson County land-record contact information, the UT CTAS directory lists a Register of Deeds contact at One Court Square, Suite 201, Trenton; confirm current location and instructions before visiting. A directory contact does not determine ownership or the procedure appropriate to a particular trust asset.

Questions to bring to the discussion

Can I use a power of attorney to make a trust distribution?

Do not assume so. A power of attorney authorizes an agent to act within that document’s scope, duration, and limits; trustee authority is a separate role governed by the trust and the property it holds.

Does calling an arrangement a trust establish how it is taxed?

No. Tax treatment and reporting depend on the trust. Grantor-trust and separate-entity treatment differ, so the label alone does not establish the reporting result.
