Revocable Living Trusts in Oak Hill
A revocable living trust is a plan for managing property through a trustee, including a successor trustee if the person who created the trust can no longer manage it or has died. The practical question is not only what the trust says, but which assets are actually titled to it and who has authority over assets that remain outside it.
Start with the ownership map
Make a simple inventory with one row for each account, property or other significant asset. Record the current owner or title, any named beneficiary, the person who can manage it now, and the document or institution that governs access. Mark uncertain details for follow-up rather than assuming the trust controls the asset.
This map helps distinguish trust property from assets governed by other arrangements. Signing a trust document alone does not establish that every asset has been transferred to it. Review the proposed ownership and coordination steps for each asset rather than treating the trust as a single switch.
IRS guidance describes a revocable living trust as a written arrangement created during life that can be changed or ended during the individual’s life. The agreement, the person responsible for trust management and the assets actually coordinated with it are separate parts of the planning work.
- List property and accounts, using partial account identifiers rather than passwords or full numbers.
- Note the current title or owner, beneficiary designation if known, and any transfer or retitling step to confirm.
- Identify who can act under the trust, a financial power of attorney, or another governing arrangement.
Compare the trust plan with alternatives
A revocable trust can name a successor trustee to manage property held in the trust under its terms. A will instead states instructions for property passing under the will and names an executor; a pour-over will may coordinate with a trust, but does not itself show that assets were retitled during life.
A financial power of attorney authorizes an agent to act on another person’s behalf, within the document’s scope, duration and limits. It is not interchangeable with trustee authority. A healthcare agent and healthcare preferences belong in healthcare planning documents, not in the trust’s financial-control provisions. Compare these roles alongside the ownership map so each asset and decision has an identifiable governing document.
Check funding and records before relying on the plan
For each asset intended to be held in the trust, gather the relevant title, deed, account statement or institution instructions and confirm what action is needed to align ownership with the plan. Do not assume a recorded document alone resolves ownership or guarantees clear title. Davidson County has a separate Register of Deeds contact listed by the University of Tennessee’s County Technical Assistance Service; confirm current contact and procedures before relying on a directory entry.
Keep a copy of the trust and related documents with the inventory, and note where current versions are stored. For financial reporting, trust income-tax treatment depends on the trust; grantor-trust and separate-entity treatment differ, so the trust’s label alone does not establish the tax result.
Questions to take into a planning discussion
Ask which assets should be owned by the trust, which should remain outside it, and how beneficiary designations coordinate with that choice. Ask who should serve as successor trustee, what practical information that person would need, and how the trust works alongside a financial power of attorney and will.
Dale Law Group, PLLC, offers revocable living trust planning as part of its Tennessee estate-planning services. For Oak Hill residents, the firm’s listed office is in Murfreesboro; the page does not imply an Oak Hill office. If an estate is later subject to administration, Davidson County Probate Court’s clerk handles estate administration in the Seventh Circuit Probate Division, and the correct procedure depends on the specific case.
Questions to bring to the discussion
Does signing a revocable living trust automatically transfer my assets into it?
No. Signing the trust does not by itself establish that each asset is titled to the trust. Use an asset-by-asset inventory to identify ownership and confirm the appropriate coordination or transfer steps.
Does a successor trustee replace my agent under a financial power of attorney?
Not automatically. A trustee and an agent under a power of attorney act under different documents and authority. Review each document’s scope and limits and identify which applies to each asset and circumstance.
