Special Needs Trusts in Mayland

A special needs trust is not simply a place to hold money. Its terms, ownership, and payments can affect SSI, so planning should connect the source of funds with the beneficiary’s support needs and the practical decisions a trustee may face. Dale Law Group, PLLC offers special needs trust planning to clients across Tennessee; its office is in Murfreesboro.

Start with the support plan, not just the trust document

Write down what the beneficiary needs support with, who is currently responsible for decisions, and which benefits or programs require attention. Separate recurring needs from occasional purchases, and note who should receive notices or be contacted when circumstances change.

This outline helps clarify the trust’s intended role. It does not determine eligibility: Social Security explains that trust ownership, terms, and payments can affect SSI, and not every trust is excluded from consideration.

Compare the funds and the proposed distribution

Before choosing how money should be held or spent, compare four things: where the funds come from, who would own or administer them, what the trust terms permit, and how a proposed payment may be treated. A trust funded from one source may raise different planning questions from one funded from another; the source and terms should be reviewed together rather than assuming a standard form fits every situation.

Then compare the proposed support with the beneficiary’s needs. Cash, a gift card, a purchase, and direct provision of food are not interchangeable for SSI purposes. SSA states that food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or gift cards for food may count as unearned income. Help with shelter can affect SSI. These distinctions make it important to check the specific payment before treating it as harmless or beneficial.

Prepare a distribution and notice worksheet

Bring a one-page worksheet with these columns: proposed need; estimated amount or item; source of funds; who would receive or pay the funds; whether the support involves food or shelter; and who should be notified or asked to review the decision. Add a separate list of benefits, current notices, and contact information for the people involved in administering them.

Use the worksheet to identify questions—not to make a benefits determination. For each proposed distribution, ask whether it is cash, a purchase, food provided directly, or shelter assistance; whether the trust terms allow it; and what records or notices may be needed. Keep benefit notices and trust records together so a trustee can explain the decision and seek advice when needed.

        Clarify roles and next steps

A trustee, an agent under a power of attorney, a court-appointed guardian or conservator, and a government-appointed benefit fiduciary are different roles. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not automatically grant every authority. Identify the document and the role before relying on someone to manage funds or make decisions.

Dale Law Group, PLLC can assist with special needs trust planning. For a first discussion, consider asking: What funds are expected to go into the trust, and from what source? Which support needs should the plan address? How should a trustee assess proposed cash, food, or shelter assistance? Who should receive benefit notices, and what authority does each person actually have?

Questions to bring to the discussion

Does putting money in a trust automatically protect SSI eligibility?

No. SSA says trust ownership, terms, and payments can affect SSI. Whether a particular trust is excluded cannot be assumed; the specific trust and proposed distributions need review.

Are food, cash, and shelter treated the same for SSI?

No. SSA states that food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or gift cards for food may count as unearned income. Help with shelter can affect SSI. Consider the exact form of support before making a distribution.
