Trust Administration
Trust Administration in Friendship
Serving as trustee can involve more than following a list of instructions. Before moving money or property, identify which document gives you authority, what the trust requires, and what information is still missing. Dale Law Group, PLLC offers trust-administration services to clients in Tennessee, including Friendship.
Start with the role and the controlling documents
A trustee’s authority comes from the trust and the trustee’s role—not simply from being a relative, an executor, or someone named as an agent under a power of attorney. Those roles are distinct. An executor handles matters in an estate under a will; an agent acts for another person within the power of attorney’s scope; a trustee administers property held in the trust under its terms. One person may hold more than one role, but that does not make their powers interchangeable.
Gather the trust and any amendments, documents identifying the current trustee, relevant account statements, and records showing how property is titled. If documents conflict, an amendment is missing, or you cannot tell whether an asset belongs to the trust, pause before treating it as trust property or distributing it.
- Compare the trust’s instructions with account ownership and beneficiary-designation records.
- List missing, inconsistent, or unclear documents rather than filling gaps with assumptions.
Use a distribution log before making decisions
A simple written log can make administration more deliberate. For each proposed distribution, record the asset, its current ownership or account title, the trust provision that appears relevant, the intended recipient, the amount or property proposed, supporting records, and any unresolved question. Mark each item as pending, approved for action, or on hold, and note the reason. This is a preparation tool, not a substitute for interpreting the trust.
Compare each proposed distribution with the trust’s terms and the available account records. If the trust’s language is unclear, a recipient’s interest is uncertain, or the records do not establish that the asset is held by the trust, keep the item on hold while the issue is reviewed. Do not assume that a direction in a will, a power of attorney, or a beneficiary form changes the trust’s instructions.
- Keep copies of statements, correspondence, receipts, and the records supporting each decision.
- Record questions about authority, ownership, timing, or missing paperwork beside the affected item.
Resolve ownership and tax questions separately
A trust’s name alone does not determine its income-tax treatment. Grantor-trust treatment and separate-entity treatment differ, and reporting depends on the trust. Before relying on a tax assumption, identify the trust type and ask what reporting applies to the specific trust and period.
For real property, distinguish a trust-administration question from a county land-record inquiry. The University of Tennessee County Technical Assistance Service lists a separate Crockett County Register of Deeds contact at 1 South Bells Street, Suite 2, Alamo. The directory address may be a contact or mailing address; confirm current instructions before visiting. A directory listing or recorded document does not by itself establish ownership or determine the proper transfer or procedure.
Prepare focused questions for a review
Bring the trust and amendments, any document naming or confirming the trustee, account and ownership records, a list of proposed distributions, and the distribution log. Identify what you have already done and what remains undecided. This helps separate routine record gathering from decisions that depend on interpretation of the trust.
Useful questions include: Which document controls this asset? Does the trust authorize the proposed distribution, and what conditions apply? What additional records are needed before acting? Does the trust’s tax treatment affect the reporting question? Trust administration is offered by Dale Law Group, PLLC as part of its Tennessee estate-planning services.
Questions to bring to the discussion
Can I use a power of attorney to administer a trust?
Not simply because you hold a power of attorney. A power of attorney authorizes action within its scope, while a trustee’s authority comes from the trust and trustee role. Review the relevant documents before acting.
Where can I ask about Crockett County land records?
The UT CTAS directory lists a separate Register of Deeds contact for Crockett County in Alamo. Confirm current contact and visit information. The directory is not a determination of ownership or the correct legal procedure.
