Trust Administration
Trust Administration in New Union
Being named trustee does not, by itself, answer what you may do with every account or when a distribution should be made. Dale Law Group, PLLC assists with trust administration, including reviewing the trust’s terms, identifying the trustee’s role, and organizing the questions that need to be resolved before action.
Start with authority, not assumptions
A trustee’s authority comes from the trust and the trustee’s role. It is different from an executor administering an estate and from an agent acting under a power of attorney. Those roles are not interchangeable, and a power of attorney’s scope and limits depend on its document.
Before moving or distributing assets, gather the trust and any amendments, documents showing who is serving as trustee, and relevant account or ownership records. Check that the proposed action is within the trustee’s authority rather than relying on a family member’s understanding or an account’s informal description.
Compare the trust terms with account ownership
An actionable first step is an asset-and-terms worksheet: list each known asset, how it is titled, the record or statement supporting that information, the trust provision that may apply, and any unresolved question. This helps distinguish property held in the trust’s name from property that may require a different analysis.
For each asset, note whether the institution has requested trust documents or other proof of authority. Do not treat a trust’s name on a document as conclusive proof of ownership or assume that every asset is governed by the same distribution instruction. Resolve gaps before making a transfer or promising a beneficiary a particular result.
- Trust instrument and amendments, including provisions relevant to the proposed action
- Records identifying the current trustee and any stated limits on authority
- Recent account statements, deeds, or other ownership records
- A written list of proposed expenses, transfers, and distributions, with supporting documents
- Correspondence identifying missing records or questions raised by an institution or beneficiary
Log proposed distributions before paying
Keep a distribution log with the date, proposed recipient, amount or property, purpose, trust provision considered, supporting records, and decision status. Mark each item as pending, approved, paid, or held for clarification. This creates a practical record of what was considered without assuming that a proposed payment is authorized.
If the trust’s terms, asset ownership, or trustee authority are unclear, pause that item and identify the exact missing document or interpretation question. Trust income-tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ. A trust label alone does not determine the tax result.
Questions to resolve for a New Union trust
For a trust connected with New Union in Coffee County, useful questions include: Which document establishes the current trustee’s authority? Does the trust address this asset and proposed distribution? What ownership record supports treating the asset as trust property? What information is still needed before deciding? Does the trust’s income-tax treatment require separate reporting analysis?
If a land record or recording issue is part of the administration, UT CTAS lists a Coffee County Register of Deeds contact at 1341 McArthur St, Suite 2, Manchester, TN 37355. This is a directory contact, may be a mailing address, and should be confirmed before visiting. A recorded document or directory listing does not determine ownership or establish which transfer or court procedure is appropriate. New Union is an unincorporated Census designated place, not a separate municipal government.
Questions to bring to the discussion
Can I use a power of attorney to act as trustee?
Not simply because you hold a power of attorney. An agent under a power of attorney and a trustee are distinct roles. The authority and limits of a power of attorney depend on its terms; identify the document that establishes the relevant role before acting.
Does every trust file a separate income-tax return?
Not necessarily. Tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ. The trust’s label alone does not settle the reporting question.
