Trust Administration in Pegram
Serving as trustee is a distinct role: authority comes from the trust and applicable documents, not simply from being an executor or an agent under a power of attorney. Dale Law Group, PLLC assists with trust administration for clients in Pegram and throughout Tennessee. The firm’s office is in Murfreesboro.
Start with the authority and the asset
Before paying expenses or making a distribution, identify the trust, the person or institution named to act, and the property held in the trust. Read the trust terms alongside available amendments and records showing how each account or other asset is titled. A trust’s name alone does not establish who owns a particular asset or what authority applies to it.
Trustee authority should not be confused with an executor’s role in an estate or an agent’s authority under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope and limits depend on the document. Identify the role and the document rather than assuming one role supplies another’s authority.
- Collect the trust and amendments, trustee acceptance or appointment records if available, and any relevant court orders.
- Gather account statements, deeds or other ownership records, tax documents, and correspondence about assets or proposed transfers.
- List missing documents and unresolved questions before taking action.
Use a decision log before distributions
A practical first step is a trustee decision log. For each proposed payment or distribution, record the date, the request, the trust provision or other document you believe addresses it, the supporting records, the people consulted, and what remains uncertain. Keep copies of invoices, statements, receipts, and communications with the entry. The log helps separate documented decisions from assumptions and makes it easier to identify a question that needs resolution before funds move.
Compare the proposed action with the trust’s terms and the asset’s ownership records. If a document is missing, the account’s status is unclear, or the trust language does not answer the question, pause that proposed action while the issue is reviewed rather than treating an informal request as sufficient authority.
Keep tax and records questions tied to the trust
Tax treatment and reporting depend on the trust. Grantor-trust treatment and separate-entity treatment differ; the trust label by itself does not determine the result. Gather prior returns, tax identification and account records, income statements, and correspondence from tax preparers so the trust’s actual structure and activity can be considered.
For land records in Cheatham County, the UT CTAS directory lists a separate Register of Deeds contact at 354 Frey Street, Suite C, Ashland City. Confirm current contact and visit information before relying on it. A directory listing or recorded document does not by itself determine ownership, guarantee clear title, or establish which transfer or court procedure is appropriate.
Prepare for a focused administration review
Bring the complete trust and amendments, a current asset and liability list, recent financial and tax records, and the decision log. Mark each asset as titled in the trust, titled elsewhere, or uncertain, and note the record supporting that description. Identify any pending bills, distribution requests, beneficiary communications, and decisions already made.

Questions to bring to the discussion
Does being named executor make me the trustee?
Not by itself. Executor and trustee are distinct roles, and authority depends on the relevant appointment and governing documents. Identify which role you hold and review the documents that grant that authority.
Should I distribute money while I am waiting for a missing trust document?
A missing document can affect whether the proposed action is authorized. Record the request and the documents you have, identify what is missing, and seek review of the issue before acting on an uncertain basis.
