Trust Administration in Valley Forge

A trustee’s first task is not to distribute property—it is to establish what the trust says, what assets are actually held in it, and which actions the trustee is authorized to take. Dale Law Group, PLLC assists with trust administration for clients in Valley Forge and throughout Tennessee.

Start with authority and ownership

Trustee authority comes from the trust terms and the trustee’s role. It is different from an executor’s authority over a probate estate and from an agent’s authority under a power of attorney. A power of attorney’s scope, duration and limits depend on that document; it does not automatically make the agent a trustee. Likewise, a trustee should not assume that every asset associated with the person who created the trust is owned by the trust.

Before acting, assemble the trust instrument and amendments, documents identifying the current trustee, and a working inventory of assets. For each account or item of property, record the owner shown in available statements or records, any named beneficiary, the institution or custodian, and the document that supports the entry. Flag mismatches rather than treating the trust’s name alone as proof of ownership or of the proper tax treatment.

  • Trust and amendments, plus any document identifying the acting trustee
  • Current account statements, deeds or other ownership records, and beneficiary information
  • A dated inventory noting estimated value, income, expenses, questions and missing records

Compare the proposed action with the trust terms

For each proposed payment or distribution, identify the governing trust provision, the person or purpose involved, and any conditions or timing language that may apply. Then compare that instruction with the asset inventory: is the asset held by the trust, and is there enough information to understand the available balance and related expenses? Keep a written decision log showing the question, documents reviewed, action taken or deferred, and follow-up needed.

This process helps separate administration questions from role confusion. An executor handles a different role; an agent acting under a power of attorney relies on that document’s authority. A trustee should not use one person’s authority as a substitute for another’s, or assume that a healthcare agent’s authority covers financial trust decisions.

    Resolve gaps before distributing

Pause a proposed distribution when the trust document is incomplete, a successor trustee’s authority is unclear, ownership records conflict, or a beneficiary or condition is uncertain. Gather the missing document or ask the relevant institution what records it needs; record who was contacted and what remains unresolved. Do not treat a land-record directory entry or recorded document as a title determination.

If trust property includes Carter County real estate, the University of Tennessee County Technical Assistance Service lists a separate Register of Deeds contact for Carter County at 801 E. Elk Avenue, Elizabethton, TN 37643. Confirm the current location before visiting. A directory listing is a contact point, not a title search or a decision about which transfer or court procedure is appropriate.

      Tax and administration questions

Trust income-tax treatment and reporting depend on the trust. Grantor-trust and separate-entity treatment differ, and the trust’s label alone does not determine the result. Keep income, expenses and supporting statements organized, and identify tax questions for review rather than assuming a filing approach from the trust’s name.

Dale Law Group, PLLC can help review trust terms, organize administration issues, assess proposed distributions and identify unresolved ownership or authority questions. The firm’s office is in Murfreesboro; Valley Forge is an unincorporated Census-designated place in Carter County, not a separate municipality.

Questions to bring to the discussion

What should I bring to an initial trust-administration discussion?

Bring the trust and amendments, documents identifying the current trustee, recent account statements, available deeds or ownership records, beneficiary information, and a list of proposed payments or distributions. Mark missing or conflicting records rather than trying to resolve them by assumption.

Does being named as agent under a power of attorney make me the trustee?

Not by itself. An agent’s authority comes from the power of attorney and its scope and limits; trustee authority comes from the trust and the trustee’s role. Identify the document governing the particular action before proceeding.
