Trust Administration in Johnson City

If you have been asked to manage a trust, start by identifying what authority the trust gives you—and which assets it actually covers. Dale Law Group, PLLC offers trust-administration services to clients across Tennessee. The firm’s office is in Murfreesboro; this page is for Johnson City and does not indicate a Johnson City office.

Confirm your role before making decisions

A trustee’s authority comes from the trust and applies to the responsibilities assigned to that trustee. It is not interchangeable with an executor’s role under a will or an agent’s authority under a power of attorney. A power of attorney authorizes someone to act on another person’s behalf, but its scope, duration and limits matter; it does not automatically make the agent a trustee.

Before taking action, gather the trust document and any amendments, identify who is serving as trustee, and check what decisions the document permits or requires. If there is uncertainty about the controlling document or the trustee’s authority, resolve that before signing, transferring or distributing assets.

Match trust terms to account ownership

A trust document alone does not establish that a particular bank account, investment or parcel of real estate belongs to the trust. Compare the trust’s terms with available account statements, deeds and other ownership records. Note assets that appear to be associated with the trust but have incomplete or inconsistent documentation; avoid treating a directory listing or recorded document as proof that a transfer or title question has been resolved.

This ownership check helps separate two questions: what the trust directs, and which assets the trustee can administer under that arrangement. Keep beneficiary designations, will instructions and trust ownership as distinct records rather than assuming they produce the same result.

Use a distribution log before funds move

Create a simple decision log for each proposed distribution. Record the asset or account involved, the relevant trust provision, who requested or may receive the distribution, the information reviewed, any unresolved question, and the decision and date. Keep copies of supporting statements and correspondence with the entry.

For example, if a request concerns an account whose ownership documents do not clearly connect it to the trust, mark the ownership question as unresolved rather than recording the payment as an approved trust distribution. This gives you a practical way to pause, investigate and explain the basis for decisions.

        Prepare a trustee review file

Bring together the signed trust and amendments, any document naming a successor trustee, current asset and account records, relevant deeds, recent statements, and correspondence about proposed distributions. Add a short list of missing documents and questions. If a tax return or tax question is involved, remember that trust income-tax treatment and reporting depend on the trust; grantor-trust and separate-entity treatment differ, and the trust’s label alone does not determine the result.

For Johnson City, municipal information is available through the official UT MTAS Johnson City profile. It is not a law-firm office or a source for deciding trust authority. If a matter also raises an estate-court filing or land-record issue, identify the relevant county and the specific question first: Johnson City intersects Carter, Sullivan and Washington Counties, and court and land-record contacts are separate. Contact listings do not determine whether a proceeding is required or which venue applies.

          Questions to resolve next

Ask: Which trust version governs? What specific authority does the trustee have for the proposed action? Which assets are titled in or otherwise associated with the trust? What records are missing? Does the distribution fit the trust terms, and what documentation should support the decision? Is a tax-reporting question separate from the question of trustee authority?

Dale Law Group, PLLC provides trust-administration services as part of its Tennessee practice. A review can help organize the trust terms, asset records and proposed actions around the questions that remain open.

Questions to bring to the discussion

Can a power-of-attorney agent act as trustee?

These are distinct roles. A power of attorney gives an agent authority described by that document, while a trustee’s authority comes from the trust. Do not assume one role grants the other’s powers.

Does a trust document mean every asset is part of the trust?

No. Check ownership records alongside the trust terms. If an account, deed or other record is unclear, document the issue and resolve it before treating the asset as available for a trust distribution.
