Trust Administration

Trust Administration in Hollow Rock

When you are asked to administer a trust, start by confirming what authority you have and what the trust actually requires. Dale Law Group, PLLC assists with trust administration for clients in Hollow Rock and throughout Tennessee.

Start with the right role and the right document

A trustee acts under the trust document and is responsible for handling trust property according to its terms. That role is not interchangeable with an executor handling a probate estate or an agent acting under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration and limits matter; it does not automatically give the agent authority over property owned by a trust.

Before moving money or approving a distribution, identify the trust, confirm who is serving as trustee, and read the provisions that address the proposed action. If a person has several roles, keep each role and its supporting documents separate. A will, beneficiary designation, trust and power of attorney can each relate to different property or authority.

Compare the proposed action with the trust terms

For each proposed payment or transfer, ask: Is the asset held by the trust? Does the trust authorize this kind of distribution, and are there conditions or limits? What records support the request, and how will the transaction be documented? If the relevant terms are unclear, documents are missing, or the asset’s ownership is uncertain, pause that action while you gather information and resolve the issue.

A useful working record is a distribution log. For each request, note the date, who made it, the amount or property involved, the trust provision considered, documents reviewed, decision and reason, and any follow-up. Keep supporting statements, receipts and correspondence with the log. This makes it easier to review decisions consistently and identify unanswered questions before taking further action.

      Prepare a focused administration file

Collect the trust and amendments, any document identifying the current trustee, and relevant records showing how assets are titled. Add current account statements, property records, bills, tax correspondence, beneficiary communications and any requests for distributions. Make a list of missing documents rather than filling gaps with assumptions. Record who holds each missing item and what you have asked them to provide.

If trust property includes real estate in or near Hollow Rock, keep deeds and other ownership records with the trust file. Carroll County’s Register of Deeds directory lists a separate land-record contact in Huntingdon; its address may be for correspondence, so confirm current instructions before visiting. A directory contact or recorded document does not establish what transfer or procedure is appropriate.

Resolve account, tax and authority questions before proceeding

Account ownership matters: a trust’s name alone does not establish that a particular asset belongs to it. Compare account and property records with the trust terms, and flag inconsistencies for review. Trust income-tax treatment and reporting depend on the trust; grantor-trust treatment and separate-entity treatment differ. Do not infer a tax result from the trust’s label alone.

Dale Law Group, PLLC offers trust administration services. A review can help organize the governing documents, identify unresolved ownership or authority questions, and consider the proposed action against the trust terms. Bring your distribution log and missing-document list so the discussion can focus on decisions that remain open.

Questions to bring to the discussion

Can I use a power of attorney to manage trust property?

Not automatically. A power of attorney and a trustee’s authority come from different sources. Check the power’s scope and the trust documents, and do not assume one role grants the powers of another.

Where should I begin if trust documents or asset records are missing?

List what is missing, who may have it, and what you have requested. Avoid making a distribution based on an assumption about ownership or authority; review the available documents and unresolved questions before acting.
