Special Needs Trusts in Camden

A special needs trust plan involves more than choosing a trust. The practical questions are what support the beneficiary needs, where contributed funds will come from, who will manage them, and how payments may interact with benefits. Dale Law Group, PLLC serves clients across Tennessee from its Murfreesboro office.

Start with the support plan, not just the trust document

Write down the support the beneficiary may need, who is currently involved, and which decisions should be handled by a trustee versus another person in a separate legal role. A trustee’s authority under a trust is not automatically the same as an agent’s authority under a power of attorney, a court-appointed guardian or conservator’s role, or a government-appointed benefit fiduciary’s role.

This working plan helps identify what the trust is intended to do and what questions remain. It does not determine benefits eligibility or guarantee that a particular trust arrangement will preserve benefits. Trust ownership, terms, and payments can affect SSI, so the terms and proposed funding need careful attention.

  • List the beneficiary’s regular and anticipated support needs.
  • Identify who currently handles financial decisions, benefits matters, and healthcare decisions, and what documents describe each role.
  • Note the people who may need information about the plan, while keeping authority to act distinct from access to information.

Compare the funding source and the proposed use

Before transferring money or property, identify whose funds are involved, how they would enter the trust, and what the trustee may be asked to pay for. Then consider the proposed distribution itself: cash, a purchase made for the beneficiary, and help with shelter should not be treated as interchangeable for SSI purposes.

For example, food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or a gift card for food may count as unearned income. Help with shelter can affect SSI. These distinctions make it important to discuss the actual payment method and expense rather than relying on a broad label such as “support.” They do not establish how a specific beneficiary’s benefits will be determined.

  • List each anticipated funding source and who owns it before contribution.
  • For recurring expenses, record the expense, proposed payee, payment method, and whether it concerns food or shelter.
  • Separate immediate support needs from longer-term funds or property the trust may receive.

Prepare a distribution and notice checklist

A concise checklist gives a trustee and the beneficiary’s support team a consistent way to review proposed payments and keep relevant information together. Include how the expense will be paid, what record will show the payment, and who should be notified if a payment or change in circumstances may matter to benefits.

Do not assume that a direct payment, reimbursement, cash transfer, or purchase has the same effect. Ask how the particular distribution fits the trust terms and what benefits-related notice or recordkeeping should accompany it.

  • Expense and purpose; proposed amount; payee; and payment method.
  • Whether the expense involves food, shelter, or another form of support.
  • Supporting invoice or receipt, the trustee’s decision record, and any benefits communication to retain.
  • Who will review the distribution and who should receive relevant notices.

Questions to resolve before funding or changing a payment

Bring the support plan, funding information, current trust documents if any, and examples of expected expenses to a planning discussion. Focus on the decision that is actually pending: whether a proposed source belongs in the trust, whether a particular payment method fits the trust’s terms, and what follow-up or notice is appropriate.

Dale Law Group, PLLC offers special needs trust planning as part of its estate planning services. The firm serves Tennessee from its office in Murfreesboro; it does not list an office in Camden. Contact the firm to discuss whether its services fit your circumstances.

  • What funds or property are being considered, and whose funds are they?
  • How might the trust’s terms and the proposed payment affect SSI?
  • Would a direct purchase, cash payment, or payment involving shelter raise different questions?
  • Who will make trust decisions, handle benefits communications, and address healthcare decisions, and what document supports each role?

Questions to bring to the discussion

Does every special needs trust preserve SSI eligibility?

No guarantee can be made. Trust ownership, terms, and payments can affect SSI. The specific trust and proposed distributions need to be considered in light of the beneficiary’s circumstances.

Are food payments treated alike for SSI?

No. Food provided in kind is excluded from SSI support-and-maintenance calculations, while cash or gift cards for food may count as unearned income. Help with shelter can affect SSI. Consider the actual payment method and expense.
