Trust Administration
Trust Administration in Rocky Top
Administering a trust starts with two questions: what does the trust authorize, and which assets are actually held by the trust? Dale Law Group, PLLC, offers trust administration services to clients across Tennessee. The firm’s office is in Murfreesboro; Rocky Top spans Anderson and Campbell counties.
Confirm the trustee’s role and authority
A trustee acts under the trust document. That authority is different from an executor’s role in administering an estate and from an agent’s authority under a power of attorney. A power of attorney authorizes someone to act for another person, but its scope, duration, and limits matter; it does not make that person a trustee. A court-appointed guardian or conservator is another distinct role.
Before taking action, locate the trust and any amendments, identify who is serving as trustee, and check the provisions that address the proposed decision. Do not assume that a family member, agent, or executor can act for the trustee—or that a trustee can control assets titled outside the trust.
Compare the trust terms with account ownership
Use an asset-and-authority list to distinguish what the trust says from what records show. For each account, property, or other asset, note the current owner or title, the supporting statement or record, whether the trust appears as owner, and any uncertainty. Then compare that information with the trust’s distribution instructions and the proposed action.
This comparison can identify a practical next step: gather missing ownership records, clarify whether an asset is in the trust, or review whether the requested distribution fits the document. Do not treat a trust’s name alone as proof that an asset belongs to it or that a particular transfer is appropriate.
- Keep copies of the trust and amendments, account statements, deeds or other ownership records, and relevant correspondence.
- Record proposed distributions separately, including the asset, amount or description, intended recipient, stated trust provision, and unresolved questions.
- Keep a dated log of information received, decisions made, payments or transfers completed, and documents supporting each entry.
Resolve gaps before making distributions
If an ownership record is missing, the trust document is incomplete, or the proposed distribution does not clearly match the trust terms, pause that action while you identify what needs clarification. A concise question list helps focus a review: Which document controls? Who has authority to decide? What record establishes ownership? What information is still needed before this distribution can be evaluated?
Trust income-tax treatment and reporting depend on the trust. Grantor-trust and separate-entity treatment differ, so the trust label alone does not determine the tax result. Keep tax questions separate from the question of who owns an asset or who may authorize a distribution.
Rocky Top records and next steps
Rocky Top is within both Anderson and Campbell counties. For real-property records, each county has a separate Register of Deeds contact listed by the University of Tennessee County Technical Assistance Service: Anderson County at 100 North Main Street, Room 205, Clinton, and Campbell County at P.O. Box 85, Jacksboro. Confirm current contact and location details before relying on an address or visiting. A recorded document or directory listing does not establish clear title or decide which transfer or court process applies.
If a trust matter also raises an estate or court-filing question, Anderson County’s Clerk and Master maintains records for Chancery, Probate, and Child Support courts and lists probate-estate responsibilities. Campbell County has separate Clerk and Master and Circuit Court Clerk contacts; those offices are not interchangeable. Contact listings alone do not determine the correct venue, required filing, or whether a proceeding is necessary. The firm serves Tennessee from its Murfreesboro office.
Questions to bring to the discussion
Can an executor or agent make decisions for a trust?
Not solely because of that role. An executor, an agent under a power of attorney, and a trustee have distinct authority. Identify the document establishing the person’s role and review its scope before relying on it.
What should I bring to a trust-administration review?
Bring the trust and amendments, records showing how relevant assets are titled, recent account statements, correspondence about proposed distributions, and your dated action log. Mark what is missing and list the decisions you need to evaluate.
